集体土地关系的调整,主要是处理国家、成员集体和集体成员三者的关系。在国家和集体成员面前,成员集体拥有对外(对国家)与对内(对集体成员)两方面的权利和义务,共同构成集体土地所有权的多重内涵。集体土地所有权的有效行使,既要考虑国家公共利益和集体公共利益,同时还要维持集体利益在国家与个体利益面前的自主性。因此,集体土地所有权具有双重公共性和双重排他性的特征。双重公共性是指集体土地所有权行使过程中,成员集体应该吸纳国家公共意志(对外公共性)和整合集体成员的公共意志(对内公共性)。双重排他性是指集体土地所有权行使过程中,成员集体公共意志在国家(对外排他性)和个体(对内排他性)面前保持一定的自主性。集体土地所有权的这几种特征相互影响,互为前提,作为一个整体,缺一不可,共同构成集体土地所有权的有机特征体系。

英文摘要:

The adjustment of collective land relations mainly deals with the relations among the state,the collective and the individual.The collective ownership of both external and internal rights and obligations constitutes collective ownership.Collective land ownership has the characteristics of dual exclusiveness and dual publicity.Dual autonomy refers to internal exclusiveness and external exclusiveness,and is the dual right of the collective.Dual publicity refers to national (external publicity) and collective (internal publicity),and is the dual obligation of the collective.The relationships among these characteristics of collective ownership are complex,and the different characteristics interact with each other and are prerequisites for each other.These four characteristics constitute the organic characteristic system of collective land ownership.In the process of exercising collective land ownership,in order to realize the interests of individuals,collectives and the state in a coordinated manner,these four characteristics as a whole are indispensable and must be realized in a coordinated manner.Because the laws and public policies related to the exercise of collective land ownership play different and complementary roles in the realization of its organic characteristic system.Therefore,the realization of the organic characteristic system of collective land ownership must be based on the synergy of law and public policy.
