| 经济公益诉讼作为一种新的诉讼类型,有着与传统诉讼类型不同的特征和功能。文章着重阐述了经济公益诉讼制度的特征和现实必要性,并对该制度的建立提出了若干设想。经济公益诉讼制度的出现既是诉讼法对只顾及私人利益的狭隘性的突破,也是对传统法律制度的超越。 |

| Economic public interest suit is used as a kind of new litigation type. It has many difference in characteristic and function from traditional litigation type. Economic public interest suit is not only a breakthrough, but also an overstep to the traditional law that suit law only regards for the private benefits. The article emphasizes to expatiate the characteristic and the realistic necessity of economic public interest suit, and put forwards some advice for the foundation of the institution. |
