| 摘 要： | 国家公园治理作为环境治理的重要突破口，与环境管制的运行逻辑之间存在矛盾，必须构建政府主导、多元主体参与的国家公园合作治理模式，以化解环境管制的困局。中央管控型、地方自治型与综合治理型的国家公园合作治理实践表明，政府、市场和公众必须在国家公园治理中形成合力，通过治理制度上合作规则的建构、治理主体上合作组织的建构及司法保护上联动机制的建构，形成政府与社会主体之间合作与制衡的治理格局，实现国家公园由行政管制向合作共治的转变。

| Abstract: | As an important breakthrough in the modernization of environmental governance, National Park governance was in conflict with the operational logic of environmental regulation. It is necessary to construct a cooperative governance model of national parks led by the government and participated by multiple subjects in order to solve the dilemma of environmental regulation. The practice of cooperative governance in national parks of central control type, local autonomy type and comprehensive governance type shows that the government, market and the public must form a joint force in the governance of national parks. Through the construction of cooperative rules in the governance system, cooperative organizations in the governance subject and linkage mechanism in judicial protection, the governance pattern of cooperation and balance between the government and the social subjects can be formed, thus realizing the transformation of national parks from administrative control to co-governance. |
