| 摘 要： | 近代学者以法治、宪法、法理、法史为视角描述和分析了黄宗羲思想的法学意义。通过回顾与整理这些文献，可知当下反思黄宗羲现代法学形象需做到三点:一是在研究中应谨慎运用现代法学概念，二是应尽可能地还原思想的历史原貌，三是应提炼符合中国传统思想特征的理论框架。只有这样才能准确地刻画黄宗羲的中国法律思想史形象，并为构建“法的中国性”提供理论给养。

| Abstract: | Huang Zongxi’s thought has been analyzed by modern scholars from the perspectives of the rule of law, constitutional law, jurisprudence and legal history. By reviewing and collating the literature, we can see that three things need to be done in order to reflect on Huang’s modern jurisprudential image. Firstly, modern jurisprudential concepts should be used with caution in research; secondly, the original historical appearance of the thought should be restored as far as possible; and thirdly, a theoretical framework that is in line with the characteristics of traditional Chinese thought should be refined. Only in this way can we accurately portray Huang Zongxi’s image of the history of Chinese legal thought and provide theoretical support for the construction of the “Chineseness of law” |
