可行能力下的土地征收增值收益分配研究——基于浙江A市案例分析

摘    要:在现行土地征收和出让制度下,土地征收增值巨大,土地征收增值收益的分配是社会关注的热点。浙江A市土地征收增值收益分配比例地方政府为50%以上,用于农民未来发展的比例为25%左右。在阿马蒂亚·森可行能力视角下,农民很少参与土地征收增值收益政策制定,地方政府土地财政依赖性强,农民分配比例低,未充分考虑农民可持续发展能力。因此,应该提高土地征收政策制订中农民的参与度,采取多元化补偿方式,提高农民可行能力。

Abstract:From the land expropriation and transfer system, the allocation of land expropriation increment income draws much social focus as its amount is huge. The local government can obtain more than 50% increment income in land expropriation and about 25% for farmers’ future development in a city of Zhejiang Province. From the perspective of Amartya Sen ’s theory of feasible capacity, farmers take rarely participate in policy formulation of land expropriation. The allocation of increment income in land expropriation to the farmer is low because the local government depends heavily on land finance. As a result, it is seldom to take the farmer’s ability of sustainable development into consideration. In order to improve the farmers’ feasible capacity, the paper puts forward some measures, such as the higher degree of farmers ’ participation in making land expropriation policy and more diversified compensation methods.
