| 摘 要： | 票据贴现后，若承兑人出现财务危机，可能面临票据到期无力付款的风险。依票据法原理，在票据无瑕疵且取得票据合法的前提下，持票人享有到期付款请求权和追索权；而票据退还请求权显然不是票据权利，无法根据票据关系推导出这种新型权利。因为票据贴现时，贴现人并非仅是对贴现申请人的信赖，而是对票据出票人乃至前面所有票据签章者的信赖。但当票据未到期，票据贴现人可能面临损失，则其可以根据票据贴现协议的约定——票据原因关系，确定是否享有票据退还请求权。

| Abstract: | After the discount of bills, the acceptor may face the risk of inability to pay when the bills are due because of the financial crisis of the acceptor. At this time, can the holder return the bill to the discount applicant? According to the principle of bill law, on the premise that the bill is flawless and the bill is obtained legally, the holder has the right of claim and recourse for due payment. However, the claim of bill return is obviously not the right of bill, which cannot be deduced according to the relationship of bill. When discounting bills, the discounter is not only the trust of the discount applicant, but also the trust of the bill issuer and all the previous bill signers. However, when the bill is not due, the bill discounter may face losses, then it can determine whether it has the right to request the return of the bill according to the agreement of the bill discount agreement - the relationship between the reasons for the bill. |
