| 摘 要： | 随着我国海洋战略的实施和海洋经济贸易的发展，海洋犯罪活动也日益猖獗。而目前，我国有关海洋犯罪的刑事法律制度相对薄弱，原因是多方面的，但最重要的是我国缺乏合理的海洋犯罪体系，不利于对海洋犯罪进行有效规制，因此，有必要构建一套行之有效的海洋犯罪体系。鉴于海洋犯罪的对象和其侵害法益的特殊性，以“海上”“海里”的二元模型构建我国的海洋犯罪体系存在着合理性，具体言之，对接国际条约中的海洋犯罪，整合新增以“海上”为场域的犯罪，建立刑法单独章节打击以“海里”为对象的犯罪，以此惩处海洋犯罪活动，保护海洋环境资源，使我国充分履行作为海洋大国的国际责任。

| Abstract: | With the implementation of China's marine strategy and the development of the marine economy and trade, marine crime is becoming more and more rampant. At present, China's criminal legal system related to marine crime is relatively weak. There are many reasons for it, but the most important is that our country lacks a reasonable system to attack marine crime. Therefore, it is necessary to construct an effective marine system to combat marine crime, In view of the particularity of the object of marine crime and its infringement of legal interests, the construction of China's anti-marine-crime system should be based on the dual model of "on the sea" and "inside the sea". We should add provisions on marine crimes in international treatiesto deal with marine crimes, establish separate sections of criminal law to crack down on crimes with "sea", so as to punish marine criminal activities, protect marine environmental resources, and enable our country to fully fulfill her international responsibilities as a major maritime power. |
