| 摘 要： | 诱导侦查并非外国才有，在中国古代的司法文化中也有体现。中国传统司法文化中的“用谲钩慝”之术类似今天的诱导侦查。中国古代司法文化中的“用谲钩慝”之术，既对疑难案件的解决“固不可废”，亦“免于追捕之烦”，具有特定时空下的合理性，该经验之术是古代司法智慧的结晶，具有周延性与可借鉴性。依据诱导公式理论，诱导侦查措施的使用存在一定限度。现代法治社会中，有必要对侦查机关的诱导侦查权力侵入保持警醒，当明晰诱导侦查的使用条件，使侦查方法从规范化、合理化逐步走向法治化。

| Abstract: | Induced investigation is not unique to foreign countries, but also reflected in ancient Chinese judicial culture. The technique of "Deceitful Hook Evil" in Chinese traditional judicial culture is similar to today's temptation investigation.In Chinese traditional judicial culture, the art of "Deceitful Hook Evil"——not only "solid without eliminating" the solution of difficult cases, but also "free from pursuit"——has rationality in specific time and space. This art of experience is the crystallization of ancient judicial wisdom, which is of circumferential and referential nature. According to the formula theory of temptation investigation, there is a certain limit to the measures of temptation investigation. In modern society ruled by law, it is necessary to be alert to the intrusion of investigative powers induced by investigative organs; and to clarify the conditions for the use of induced investigations, so that the investigation methods will gradually move from standardization and rationalization to legalization. |
