| 摘 要： | TPP协议通过扩大知识产权领域的刑法保护范围，缩减犯罪构成要件，明确适用情形，丰富处理程序，总体抬高了国际领域知识产权刑事保护的水平；而力度不足、体系失衡和概念冲突是我国当前知识产权刑法保护的症结所在。我国应借TPP协议之东风，及时更新前置性法律法规，系统调整刑事法律规范，尝试全新的刑事立法模式，以便全方位推动知识产权刑法保护制度的可持续发展。

| Abstract: | s: TPP treaty generally strengthens the IP criminal protection in international level by expanding the scope of criminal protection, decreasing constitutions of a crime, clarifying applicable cases and diversifying criminal procedures. The weak protection, unbalanced system and contradictory notions constitute the problems of current criminal protection of Intellectual Property in China. With reference to TPP treaty, we shall update those administrative laws and regulations, adjust criminal laws systematically and try new criminal legislative mode, which is beneficial for promoting sustainable development on criminal protection of Intellectual Property |
