Court proceedings are a fundamental and increasingly time‐consuming aspect of social work practice. However, to date, there is a relatively modest body of literature considering the experiences of social workers in instituting child care proceedings and giving evidence in court. This paper draws on data gathered as part of an in‐depth qualitative study of professional experiences of District Court child care proceedings in Ireland and presents findings regarding the experiences of social workers in bringing court applications for child protection orders. It seeks to answer 2 key questions: First, how do child protection and welfare social workers experience the adversarial nature of child care proceedings in the District Court? Second, what are the views of child protection and welfare social workers on the strengths and weaknesses of child care proceedings as a decision‐making model for children and young people? The main findings are that social workers expressed significant reservations about the predominantly adversarial model that currently operates in Irish child care proceedings and about the level of respect that social workers are afforded within the operation of the system.  相似文献

The ‘child’ in child welfare/protection is seen as a dependent waif and an object of interest, on whose behalf adults speak and act. An alternative perspective has argued for child‐centredness, and includes concepts of child liberation, rights and citizenship. Policymakers and practitioners who may accept the underlying principles may be concerned about the appropriateness and applicability of such principles in relation to practice with children and their parents in child welfare/protection cases. This paper discusses a conceptual framework for research that aims to explore participatory and child‐centred professional practice by critically evaluating and developing, for professional practice, the practical meanings of ‘participatory’ and ‘children as citizens’. We do not present research outcomes based on empirical data; instead, we present our conceptual framework as the first stage of research in progress into participatory and child‐centred professional practice.  相似文献

This paper draws on findings from an interview‐based study of the ways that local authority social workers, social services managers and lawyers work together in child care cases in England. The study shows how stressful social workers can find care proceedings, and how much they look to the lawyers for support. It also shows how the lawyers’ involvement can bring new stresses and dilemmas. The managers are especially likely to resent ‘over‐involvement’ (as they see it) from lawyers, but lawyers are quick to defend their role and responsibilities. The paper shows how the complex, multifaceted dimensions of care, control and change interweave with professional differences in care proceedings: care for children, parents and social workers; struggles for control against the court, the other parties and sometimes the other professionals on one's own side; and responsiveness to change set against wariness about ‘lawyers’ deals’ and undue risk to children. The paper concludes that the valuing of difference, rather than its avoidance or suppression, is at the heart of effective inter‐professional work. It calls for greater recognition of this in current initiatives to promote interdisciplinary working in children's services in England.  相似文献

ABSTRACT This is a study of the processes for freeing children for adoption in Northern Ireland. The focus was the time taken from admission to care to adoption order. The findings confirmed that the process is dogged by delay at each stage. In total the average time from the child becoming looked after to the granting of an adoption order was 4.5 years. Most of the time taken was in the stages for which social services had lead responsibility, principally the decision to pursue adoption as the plan for a child. The children were very young when admitted to care – average age 1 year 7 months. Most were admitted to care because they were being neglected. Their parents were well known to social services and had multiple problems. Most parents unsuccessfully contested the social services’ application and this contributed much to the delay. Their former foster parents adopted almost half of the children and these children tended to be placed more quickly with their adopters than those placed with adopters who were not their foster parents prior to the adoption process.  相似文献

While a wide range of literature exists on the experiences of children in foster care or adoption, much less is known about children who return home from care to their birth parents. This paper focuses on the perspectives of a small sample of birth parents of young children who returned home from care. It draws on findings from the Northern Ireland Care Pathways and Outcomes Study that has been following a population ( n  = 374) of children who were under 5 years and in care in Northern Ireland on the 31st of March 2000. As part of this study, interviews were conducted with the foster parents of 55 children, the adoptive parents of 51 children and the birth parents of nine children who had returned home from care. The paper explores the birth parents' views on how they coped while their child was in care, how they were coping after the child had returned home and how their child was faring at home. Results revealed that these parents, and their children, were experiencing multiple difficulties and struggled to cope after the children had returned home.  相似文献

Within the context of kinship care, the main objectives of this work are to study the characteristics of contact between foster children and their birth parents, and their relationship with key variables of fostering, the children and their kinship caregivers. The sample included 189 children from Spain and their kinship families. A semi‐structured placement interview and two scales relating to the child–caregiver relationship and child's psychological adjustment were used with the kinship families. The results revealed a significant percentage of foster children who had no family contact. Various visit types, frequencies and durations were described. Kinship care with contact, compared with placements without contact, was frequently characterized by the absence of professional supervision, and an affectionate child–caregiver relationship; moreover, children with contact were perceived to have fewer serious behaviour and socio‐emotional problems and a greater probability of family reunification. The regression analysis showed that the main predictors for how caregivers assessed contact were the children's emotional reaction during visits and the quality of the relationship between the kinship families and the birth parents. These results suggest the need for further research about contact, which will certainly have a major impact on professional intervention with these families.  相似文献

This paper draws on the author's experience of undertaking play therapy with the brothers of sexually abused children. It illustrates the range of difficulties that such boys may face and identifies implications for professional practice. Difficulties are understood as arising from the struggle to develop a coherent narrative about the abuse, often in the face of incomplete or contested information. The outcome is influenced by the nature of the child's attachment relationships with his non‐abusing parents or carers, his abused sibling and with the abuser himself. This struggle for a coherent narrative about the sexual abuse can have a significant impact on the development of a sense of masculine identity, particularly when the abuser is the boy's own father and/or the abused child is male. In the context of increasing professional awareness of the need to support siblings of sexually abused children it is argued that there should be a specific focus on gender and identity issues for boys.  相似文献

Matching describes the process of selecting the substitute home for a child who needs to be placed away from the care of his/her birth parents. However, very little theorizing is done about matching and there is also a lack of systematic investigation into models of practice currently in use. Most importantly, very little is known about front‐line matching practices in different socio‐historical child welfare contexts. This paper aims to explore the concept of matching by addressing it theoretically and empirically as a decision‐making practice in social work. Based on the analysis of phone interviews (49) and focus group interviews (five groups with 18 child welfare practitioners) in Finland, we claim that matching includes a high degree of navigation: decision‐making balances between professional discretion, legal norms and principles, subjective views of the children and their parents as well as the economic and bureaucratic conditions of the service provision administration in the municipality. Navigation is shadowed by uncertainty and compromises. The analysis suggests that the notion of matching needs further analysis as it plays an important role in child welfare decision‐making. The interplay between front‐line practice and the socio‐historical context needs to be further addressed.  相似文献

Clinical studies of children in international adoption reveal unique patterns of psychological adjustment to permanent family care. Pre‐adoption history often includes early object loss, medical and nutritional deprivation, multiple care‐giving disruptions, and the lack of primary care‐giving relationships. These factors and the age at the time of adoption are risks to positive emotional and cognitive development. Adoptive parents may be unprepared for the resulting developmental problems. Most significantly, parents and children are often at different points in readiness to establish an attachment relationship. The parents are eager to claim their child, but the child is unready to respond because of emotional fragility and lack of previous attachment experiences. Two clinical vignettes illustrate the importance of a developmental and medical framework in assessing the unique needs of these survivor children, as well as the necessity of an empathic therapeutic holding environment that can sustain the emerging family attachments under stress. The psychological impact of cross‐cultural adoption and traumatic early beginnings reverberates across time but with empathic parental care and treatment recovery can be significant.  相似文献

The renewed interest in relationship‐based practice can be understood in the child care social work context as a response to the call to re‐focus practice in this field. Relationship‐based practice challenges the prevailing trends which emphasize reductionist understandings of human behaviour and narrowly conceived bureaucratic responses to complex problems. In so doing practitioners engaged in relationship‐based practice need to be able to cope with the uniqueness of each individual's circumstances and the diverse knowledge sources required to make sense of complex, unpredictable problems. This paper argues that if relationship‐based practice is to become an established and effective approach to practice, practitioners need to develop their reflective capabilities. An outline of contemporary understandings of relationship‐based and reflective practice is offered and findings from doctoral research drawn on to identify how reflective practice complements relationship‐based practice. The product of this complementary relationship is enhanced understandings across four aspects of practice: the client, the professional self, the organizational context and the knowledges informing practice. The paper concludes by acknowledging the inextricably interconnected nature of relationship‐based and reflective practice and emphasizes the importance of practitioners being afforded opportunities to practise in relational and reflective ways.  相似文献

This paper describes the work of three Action Learning Sets – two groups of child care social workers and one group of health visitors. Given the substantial investment in child care research and its dissemination, we wanted to examine barriers to effective practice from the vantage point of workers themselves. Our core question was: ‘What can we do about the things that get in the way of effective practice?’ The method, based on that of ‘co‐operative inquiry’, sought to engage front‐line practitioners as active collaborators in the research. While several of the barriers can be seen as part of the common predictable experience of professionals working in large public sector organizations, a key message is the importance of re‐invigorating models of supervision that can sustain high quality practice. What emerges is a contemporary picture of the pressures on child care workers and of the struggles to make sense of professional roles in different organizational landscapes. We are committed to evidence‐based practice, practice that is derived from the best knowledge available. We would simultaneously stress the importance of ‘holding environments’ to promote effective learning. Our experience suggests that Action Learning offers a constructive method for encouraging such environments and facilitating better practice.  相似文献

Statute and practice relating to s.31 part IV of The Children Act 1989 allow children subject to care orders to be placed at home with their parent(s). It is not uncommon for the courts to accept a plan for children to return home at the final hearing of care proceedings at which full care orders are granted. In such instances, children retain looked‐after status but, in terms of their day‐to‐day care, are looked after by parent(s). Whilst there are a small number of studies conducted in the 1990s relating to children ‘home on trial’, there is a much more limited recent literature. It is important to revisit this population of children, given current concerns about the burgeoning costs of child care proceedings and the looked‐after children system (LAC). This paper reports on a small‐scale exploratory study in one north‐west local authority area. Consisting of a file study and interviews with parents and professionals, the study examines the factors that contributed to initial removal of children to public care, the impact of the LAC system for children ‘home on trial’, stability of placements at home, as well as issues to do with the discharge of care orders. Particular attention is drawn to lone father headed households, a social group over‐represented in our sample. The study aims to inform further multi‐location studies.  相似文献

Research on child protection practice has been concerned mainly with the problem of the maltreating parent. System philosophies and processes and the influences on these, while addressed by some authors, have not received the attention they deserve. Understanding the ways in which child protection practices are constructed offers insights into the equitable or otherwise application of these processes to different groups of parents within our communities. In the study reported here we examine how child protection workers make decisions about removing children and subsequently initiating court proceedings. By focusing our analysis on a particularly vulnerable group of parents, those with intellectual disability, we highlight the ways in which child protection workers carry out their legislative mandate to keep children safe.  相似文献

This paper draws on the findings of a project, funded by the Economic and Social Research Council of the UK, examining how child and family multidisciplinary teams learn and work together. It outlines the approach taken by the research team before going on to explore New Labour policy around ‘joined‐up thinking’. The paper focuses on the role of social workers in the teams and uses qualitative data to explore the experience of social workers in relation to four key issues: models of professional practice, status and power, confidentiality and information sharing, and relations with external agencies. We argue that these are complex and contested issues that are challenging for the workers concerned. We conclude that whilst joined‐up working is complex and demanding, social work is well situated to meet the challenge, and that social workers in multidisciplinary teams are committed to making them work.  相似文献

Contact between parents and children in care is a contested area. Parental contact is recognized to be important, yet may present protective issues; in the kinship care environment, it brings the particular challenges of complex family relationships. Seeking the parents' perspective in a child protection context is difficult and therefore under‐researched. This paper describes a nested study within an Australian research project on family contact in kinship care in which the perspectives of 18 mothers and 2 fathers were sought via in‐depth interviews. Mothers and fathers described strong feelings of disempowerment in the context both of their family and the child protection system. The relationship between parent and caregiver emerged as a significant issue. All of the parents wished to remain in contact with their children in a meaningful way, whether or not they were likely to resume their children's care; however, contact arrangements presented many difficulties for them. Mothers articulated the need for services that are more empowering and respectful, rather than oriented towards them as failed parents. In order to build appropriate models of support and intervention, we argue for a more inclusive conceptual frame for family life that gives greater recognition to the role of non‐custodial parents in the lives of their children.  相似文献

Although each Australian state and territory has its own adoption legislation and its own social welfare department, they have combined to send inter-country adoption delegations to Asian countries to negotiate working arrangements on a uniform basis. When a child is adopted by people in another country, care needs to be taken in both countries by authorities, professional workers and parents to ensure that the best interests of the child are paramount. Over 1,000 children from Asian countries have been adopted by Australians. There is a dearth of published research material, but there are indications that most of these adoptions are proving very satisfactory for the children. To protect the child's status in terms of name, nationality and guardianship, it is important that policies and procedures in relation to adoption practice, immigration, and statutory recognition of overseas adoptions adequately complement each other.  相似文献

The construction of parents' cannabis use in the context of child protection has far-reaching implications for how their parenting is perceived and assessed and for the decisions made regarding their children's lives. Yet little is known about the meanings various stakeholders in child protection processes attribute to parents' cannabis use. This paper aims to explore constructions of parents' cannabis use in child protection court proceedings and position them within a political and social context. A qualitative data mining method was used to examine 32 Family Court judgements in care proceedings that involved parents using cannabis in England and Wales. The analysis of the judgements revealed that most portrayed parents' cannabis use as a negative, deviant and harmful activity. Three constructions of cannabis use were identified: cannabis use as a risk to children, cannabis use as proof of parents' deficits, and cannabis use as (responsible) self-medication. The discussion considers the findings in light of two social and political processes that underpin child protection policy and practice: the adoption of a risk perspective and the manifestation of othering processes. Implications for policy and practice highlight the importance of developing a critical framework for responding to parental cannabis use.  相似文献

Humanitarian reasons are often reported as the main motivating force for undertaking intercountry adoption. This article reports on a qualitative interview‐based Australian study in which 32 adoptive parents and prospective adoptive parents talk frankly about their desire to use intercountry adoption as a pathway to parenthood, rather than as an altruistic method of providing a child with a family. The study aimed to investigate motivations of intending and recent adoptive parents for deciding to form a family through intercountry adoption and to contribute to understanding about why intercountry adoption is the preferred option over available alternatives for family formation. The findings from this study raise interesting questions regarding recruitment efforts for children needing families; not only in relation to intercountry adoption, but also in developing recruitment strategies for foster carers for local children needing care.  相似文献
