与古代希腊、罗马及日耳曼不同, 中国古代国家起源走的是一条构建和谐的道 路, 即没有打碎氏族制度, 而是在普遍存在的氏族组织的基础上滥觞国家的萌芽, 国 家与氏族长期并存而使早期国家完善与发展。氏族制度的长期存在和发展, 这一古代 中国独具特色的社会结构是和谐构建之路的深厚社会基础。古代中国早期国家构建过 程中, 十分关注各个氏族、部落的情、义、利、患等问题。这种关注与社会实践成为 构建和谐的基石, 也是那个时代的领导者成功的标识。直到古代中国早期国家成熟 时, 还能够看到构建和谐理念的痕迹。

Unlike the ancient Greek, Roman and German states, ancient Chinese states took a path of harmonious construction which did not involve abolition of the clan system. It was on the basis of the existing clan organization that the first shoots of the state sprouted, and the state and the clans underwent a long coexistence which allowed the early state to develop and be perfected. The unique social structure of ancient China—the long existence and development of the clan system—was the underlying social foundation for harmonious construction. The early Chinese states were much concerned with the feelings, opinions about right and wrong, advantages and calamities of the clans and tribes. This concern and social practice was the foundation stone for harmonious construction, as well as the benchmark for success for the leaders of the time. Traces of the idea of harmonious construction are apparent up to the full development of the early state in ancient China.  相似文献

比照近代民法以财产法为中心, 现代民法强化了人文关怀, 主要表现为从以财产 法为中心到人法地位的提升, 并广泛体现于民法中主体制度的发展、人格权的勃兴、 合同制度的发展、物权法的发展、侵权法的发展、婚姻家庭法的发展等各个方面。中 国未来的民法典应当以人文关怀构建价值理念, 注重对人的自由和尊严的充分保障以 及对弱势群体的特殊关爱。基于这一理念, 在中国未来民法典中有必要增加人格权法 和侵权责任法编。在中国民法的适用等方面更应强化人文关怀。

In contrast to early modern civil law, which centered on property law, modern civil law shows intensified humanistic concerns. This is mainly reflected in the rising status of personal law, and is also widely evidenced in the development within civil law of the subject, personal rights, the contract system, real right law and tort law, as well as marriage and family law. China’s future civil code should construct civil law values based on humanistic concerns and highlight the full protection of human freedom and dignity and special care for disadvantaged groups. In line with this idea, it is necessary to include law on personal rights and tort law in the future civil code. Humanistic concerns should be strengthened in the application of civil law.  相似文献

在古代中国, 在夏商周时期的上古社会, 邦君与贵族领地或采邑之间的某种隶属 关系并不等于秦汉以后郡县制下中央与地方的那种具有行政级别的行政管理关系。那 种只有具有四级聚落等级形态才表示国家已形成的理论是有局限性的, 它并不能说明 国家是否产生这一问题的实质, 因而也不应作为衡量的标准。将聚落考古学与社会形 态学结合起来研究古代国家和文明的起源, 固然要对聚落的等级做出划分, 同时还必 须对史前社会组织、等级、阶层、阶级的产生、权力性质的演变等因素进行多方面的 考察。因此, 将阶层阶级的出现和凌驾于全社会之上的强制性权力的设立作为国家形 成的标志是最具特征性的, 而且在考古学上可以找到其依据和物化形式, 因而具有可 操作性。

In ancient China, in Xia, Shang and Zhou society, the relationship of subordination between the head of a state and the territories or fiefdoms of the nobles was not equivalent to the administrative relationship between the central government and the localities under the system of prefectures and counties introduced in Qin and Han times. Any theory of state formation based solely on a four-tiered settlement hierarchy is limited; it fails to explain the essential question of whether a state has come into being, and thus cannot be regarded as a criterion for judgment. It is true that in integrating settlement archaeology with social morphology in research on the origins of the ancient state and civilization, we need to classify settlement hierarchies. At the same time, however, we still need to conduct extensive research into the appearance of prehistoric social organizations, hierarchies, strata and classes, as well as the evolution of the nature of power, etc. Therefore, it is the emergence of strata and classes and the establishment of a coercive power that stands over and above society that are the most characteristic indicators of state formation. Further, we can provide archaeological grounds and materialized forms for this approach, which thus possesses operability.  相似文献

Macao was one of the earliest port cities in China to be opened to foreigners; but how, under the institutions of Ming dynasty China, it should be opened to the Portuguese, and what its character and function should be, were subjects that triggered controversy both at court and among non‐officials. It was only after a lengthy process of evolution that Macao finally developed into a commercial city. The special political environment, administrative patterns and social experiences of early Macao created a unique character and tradition of “harmony amidst difference, and difference amidst harmony” that was maintained for centuries with undiminished vitality.  相似文献

在社会公正问题的大讨论中﹐ 罗尔斯、诺齐克、哈耶克、麦金泰尔等当代西方思 想家的论述被反复引用和申说﹐ 而将马克思恩格斯等经典作家的观点置于一种被忽视 甚至被忘却的状态。形成这种状态的原因是多方面的。对历史背景和语境不作具体的 分析﹐就难以把握马克思恩格斯对于社会公正问题的真实态度和精神实质﹐ 甚至会 得出他们不仅没有关于社会公正的理论﹐ 而且反对和拒斥从社会公正角度讨论问题 的结论。马克思主义作为无产阶级认识和改造世界、求得自身解放和人类解放的世 界观和方法论﹐ 是真理与价值相统一的理论﹐ 也只有从科学向度与价值向度辩证统 一的角度﹐ 才可能对作为价值之一种表现的公正问题作出合理的理解。公正既是一 种价值观念﹐ 具有评价标准的功能﹐ 也是实际的价值(包括利益、机会、权利等)分 配的一种状态﹐ 其中会涉及自由与平等的矛盾、形式公正与实质公正的矛盾、一般 与特殊的差别、平等与效率的抵牾、公正与不公正的对立﹐ 等等﹐ 只有运用辩证思 维的方法﹐ 才能对其复杂性获得正确的认识。

In the wide ranging discussion of social equity issues, the theories of contemporary Western thinkers such as Rawls, Nozick, Hayek and MacIntyre are repeatedly cited and expounded. By contrast, for various reasons, classical writers like Marx and Engels have been overlooked or even forgotten. Without a concrete analysis of their historical background and context, it is hard to grasp the true attitude and spiritual essence of the views of Marx and Engels on social equity. We might even conclude not only that they had no theory of social equity but that they opposed and rejected approaching questions from this angle. As a world view and methodology enabling the proletariat to know and transform the world and liberate themselves and mankind, Marxism is a theory that unites truth and value. A rational understanding of the issue of equity as an expression of value is only possible when the dimensions of science and value are dialectically combined. On the one hand, equity is a value concept that functions as a standard for evaluation; on the other, it refers to an actual state of values distribution (including interests, opportunities and rights) that inevitably involves the contradiction between freedom and equality and between formal and substantive equity, the difference between the general and the specific, the conflict between equality and efficiency, the opposition between equity and inequity and so on. Only a dialectical mode of thinking can ensure a correct understanding of the complexity of social equity issues.  相似文献

中西方国家政府绩效管理在宏观环境, 制度基础,功能定位等方面存在着诸多差 异,政府绩效管理的价值定位,指标体系,实施机制等要素也不尽相同。我国各地政 府在实施绩效管理的实践中借鉴西方绩效管理的经验, 又不单纯停留在制度移植与 照搬层面,而是着眼于我国经济社会发展, 人文环境,政府改革现状等实际,立足比 较,反思与超越的眼界,建设体现中国国情的中国式绩效管理模式,以积极推进政府 管理改革事业。基于政府绩效管理中西方之间经验的比较,分析中国特色的政府绩效 管理的实质和理论价值,可以发现这是一种新模式, 即创效式绩效管理模式,这一模 式涵括的体制,机制,功能, 辅助性创效等内在结构是完善的, 其未来发展路径还有 待深入探讨

Chinese and Western government performance management differs in terms of their macro-environment, institutional foundation and functional definition, as well as in their values, indicator systems and implementation mechanisms. In their practice, local governments in China go beyond institutional transplantation and imitation while learning from Western experience in performance management. Through comparison, reflection and efforts to surpass the West, and on the basis of the realities of China’s socioeconomic development, cultural conditions and governmental reform, they have initiated a Chinese performance management model that fits China’s conditions, with a view to vigorously advancing the enterprise of administrative reform. From comparing experience in China and the West and analyzing the essence and the theoretical value of the Chinese model, we can conclude that it is a new model that pursues innovation-led performance improvement. It has a well-established internal structure that seeks performance improvement across the dimensions of institutions, mechanisms, functions and supplementary aspects. Nevertheless, the approach to be taken in its future development remains to be further studied.  相似文献

统筹城乡发展要求政府承担促进农业农村发展的责任。我国政府以国家干预、政 府主导为特征的农业农村政策,在农业发展、农民增收和城乡协调发展等方面都已取 得较大进展,但现有农业政策在提高农业生产率方面的限度日益显现。有鉴于此,急 需构建一个政府调控和引导农业农村发展的新的分析框架,在其中,政府需要界分与 市场、农村社会组织之间的行为边界,在充分尊重市场配置资源的基础性作用、尊 重农村社会自主管理的基础上,体现政府职能的“兜底”特征;而且,政府在构建市 场/社会运行的基本制度、匡正和补充市场/社会失灵、培育市场/社会主体等职能中需 要进行逻辑先后排序。应用这一新分析框架,加强和改善政府对农业农村发展的调控 和引导,就需要基于农业市场化取向改革农村基本经营制度和农业支持保护体系,注 重对农业生产市场主体的培育;需要以政府为主体构建城乡一体化的基本公共服务体 系,创新农村社会管理体制,充分调动社会力量参与公共事务治理;需要基于城乡一 体化要求重构政府行政管理体制,确保农业农村发展政策的落实。

The integrated development of urban and rural areas requires that the government take responsibility for the overall development of the countryside. Chinese agricultural and rural policies characterized by state intervention and government leadership have played an important role in promoting agricultural development and increasing farmers' incomes as well as balancing development in urban and rural areas. However, the effectiveness of current agricultural policies in promoting agricultural productivity is now clearly leveling off. Given this situation, the authors argue that it is imperative to construct a new analytical framework featuring government regulation and guidance of agricultural and rural development. In this framework, the government must clearly define the boundaries between its activities and those of the market and rural social organizations. While fully respecting the fundamental role of the market in allocation of resources and rural self‐management, the government should exercise its power as a backstop. Further, the government needs to establish a logical sequence for government functions such as formulating the basic operating system of the market and society, correcting market failure and social dysfunction and cultivating market/social entities. To use this new analytical framework to strengthen and improve its regulation and guidance of agricultural and rural development, the government needs to reform the basic rural management and agricultural support and protection systems and to pay attention to the cultivation of market entities in agricultural production on the basis of agricultural marketization. Furthermore, it needs to construct a basic urban‐rural integrated public service system with the government as the leading actor, carry out innovations in the management system of rural society and fully mobilize the social forces to take part in the administration of public affairs. It also needs to reconstruct the system of government administration and management to ensure the thorough implementation of agricultural and rural development policies.  相似文献

China's social transformation since reform and opening up in 1978 has provided a unique social laboratory for Chinese researchers of social psychology. In order to describe, understand and interpret the psychological and behavioral logic of the Chinese people, we need to call on social psychology research or social transition psychology research that looks directly at social transition, in order to go beyond the cultural exceptionalism and static society approaches. “Snow’s proposition” points out the contradictions and conflicts between “scientific culture” and “literary culture” and the dilemma of the development of the “two cultures.” In the positive sense, Snow’s proposition concerns the contradictions between the integrity of the research subject and the particularity of established disciplines, as well as the trend toward division and isolation in subdivisions of the humanities and social sciences. The key to solving Snow’s proposition is to take an inter-disciplinary path that pays particular attention to combining discipline-centered with issue-centered research and individual work with teamwork, giving full play to individual endowment, social orientation and environmental orientation and to the optimization of evaluation systems and mechanisms.  相似文献

In step with reform and opening up, the Chinese system of anti-corruption charges has been progressively refined and elaborated. Its successive refinements and comprehensive transformation have resulted in a tight-knit network of anti-corruption criminal law and a dual system of charges. This system has made a remarkable contribution to combating corruption over the last three decades. More than the outcome of the natural evolution of legal logic, it also involves complex considerations of social transformation and reflects lawmakers’ expectations of being able to prevent corruption at the institutional level. With the deepening and widening of reform and opening up, China’s system of anti-corruption charges will inevitably develop towards the thorough abolition of the dual system of charges and the complete restoration of the unitary system.  相似文献

A high incidence of corruption cases is a conspicuous feature of China’s present stage of social transition. Responding to the demands of combating corruption, Chinese criminal justice has developed a unique set of investigative methods and principles for handling of such cases, placing a high value on relying on the masses to find and act on cases of corruption and promptly adjusting its focus to the key areas of such crimes. It concentrates on enhancing investigative capacity and strengthening the standardization of anti-corruption criminal justice. These practices represent the concrete embodiment in the field of criminal justice of the government’s anti-corruption strategies. At the same time, China also faces some challenges in adjusting these procedures to accord with international practice. This is one of the aims of the judicial reform in China.  相似文献

中国的决策体制是中国政治体制的中枢系统, 也是决定中国发展的关键因素。以 中国共产党为领导核心的决策体制是在中国共产党领导革命、创建新中国的长期历史 中形成的, 具有其历史合理性。决策体制从建立到改革开放前呈现集中化的趋势。决 策权力日趋集中的体制, 存在着决策结构专业化分工程度不高、制度化程度低、偏重 经验决策、决策过程封闭和缺乏自我修正与调节机制等弊端。改革开放后, 决策体制 改革的重点, 是在决策结构、决策方式和决策机制三个主要方面推进决策的民主化、 科学化和法治化建设。决策体制改革的实践证明, 以决策民主化、科学化和法治化为 导向的决策体制改革, 成功应对了中国由经济和社会迅速变迁所带来的各种挑战。从 政治发展的角度看, 决策体制改革呈现出的基本趋势是: 从个人决策向民主决策、从 经验决策向科学决策、从决策组织高度集中向决策组织结构分化、从封闭式决策向开 放式决策、从被动参与决策向自主参与决策、从决策非制度化向决策制度化转变。一 个中国共产党主导、多方参与、科学论证、过程开放、依法运行的决策模式在决策体 制改革的实践中初步形成。

The decision-making system is the backbone of China’s political system and a crucial factor determining its development. The decision-making system with the CPC lying at the core results from the CPC’s long history of leading China’s revolution and establishing the People’s Republic of China; therefore it has historical rationality. Decision-making was centralized over the period from the foundation of the PRC to reform and opening up. This centralized decision-making system had faults such as a low level of specialized division of labor, low institutionalization, an undue emphasis on experience, a closed decision-making process and the absence of any self-correcting and adjustment mechanisms. The reform of China’s decision-making system in the post-reform period has attached much importance to promoting democratic, scientific and law-based decision-making with regard to decision- making structures, modes and mechanisms. Practice proves that this reform has successfully met the challenges arising from rapid social and economic transition. Viewed from the perspective of political development, it involves an evolution from personal to democratic, from experience-based to scientific, from centralized to decentralized, from closed to open, from passive to active participation and from non-institutionalized to institutionalized decision-making. A decision-making model has gradually taken shape that is characterized by CPC domination, participation by multiple entities, scientific proof, open process, and law-based operation.  相似文献

如何划分宪法赋予公民的言论自由权利与网络时代言论型犯罪的界限,是当下司 法实务面临的重要问题。在言论型犯罪的构造中,应纳入事实与观点二分法、公事 与私事二分法、客观真实与主观真实二分法,将合理确信规则下的”主观真实”作为 踲法阻却事由;基于网络媒介的科技特点与社会属性,网络服务提供者只具备中立义 务,对之不应简单地以共犯理论或不作为犯罪理论予以入罪。在言论型犯罪的诉讼 中,原则上须根据实际或推定的被害人意愿来启动刑事诉讼程序,当言论行为严重危 害社会秩序和国家利益且被害人无法表踡其是否告诉意思时,可直接蹇用公诉程序; “严重危害社会秩序和国家利益”等入罪基准须是现实物理的秩序混乱,且行为人要 对其有故意而无任何正当目的。对跷微言论犯罪不应跷易蹇用有期徒刑的刑罚;信息 网络工具具有很大的生活用途,一般不应没收。  相似文献

作为“权利”的学术话语权,主要有创造更新权、意义赋予权、学术自主权等类 型;作为“权力”的学术话语权,主要有指引导向权、鉴定评判权、行动支配权等类 型。这些也体现在中国社会学百余年的发展历程中。在中国社会学初创阶段,严复等 人在社会学本土化和学术话语创新方面进行了尝试。费孝通经历了中国社会学前期发 展阶段近20年及后期56年全过程,其学术历程对于中国社会学发展史具有典型意义。 在理论自觉基础上努力达致学术话语权的制高点,是中国社会学从世界学术格局边陲 走向中心的一条必由之路。

As a kind of right (quanli 权利), academic discourse rights include the right to create and innovate, to endow with meaning and to academic autonomy. As a kind of power (quanli 权力), it refers to the power to guide, judge, control and so on. These rights and powers have been pursued as Chinese sociology developed for over a century. At the inception of sociology in China, Yan Fu and other scholars experimented with localizing sociology and innovating academic discourse. Fei Xiaotong’s life covered nearly 20 years of Chinese sociology’s early development and another 56 years of its later development; his academic journey epitomizes the historical development of Chinese sociology. The only way for Chinese sociology to move from the periphery of world academia into the center is to endeavor, on the basis of theoretical self-consciousness, to seize the commanding heights of academic discourse rights.  相似文献
