Previous literature has found historically marginalized groups report more negative perceptions of the criminal justice system and lower levels of procedural justice, which then influences their mental health and their willingness to report crimes. While previous research on procedural justice has focused mostly on racial and ethnic minority groups, it is hypothesized that lesbian, gay, bisexual, transgender, and queer (LGBTQ) individuals would also report negative experiences of the criminal justice system. The current study utilized focus groups with 16 participants who identified as lesbian, gay, bisexual, and queer (LGBQ), with ages ranging from 26 to 35 years (M = 30.5 years, SD = 3.5). Participants were asked open-ended questions about how they felt about various aspects of the criminal justice system (e.g., police officers, courts, legal processes, etc.). Through the consensual qualitative research (CQR) process, researchers identified five domains that influenced participants’ experiences of the criminal justice system: (a) gender presentation, (b) influences of intersectional identities, (c) systemic and political issues, (d) experiences of discrimination, and (e) help-seeking behaviors and the criminal justice system. ABSTRACT

This article examines recent scholarship proposing the use of memory practice to remedy the traumatic aftermaths of Nigeria-Biafra War past. The assumption sustained in this scholarship is that through certain cultural memory practices such as truth commissions and commemorative rituals some form of appeasement might be reached regarding the extent of subsistence of that traumatic past. We fault these scholarly claims proposing memory as panacea to mass injustices and tragedies. In addition to the problematic proposals for using memory to remedy past atrocities in Nigeria, we observe that the question of justice is either absent or construed sometimes vaguely as one and the same with memorialisation. Accordingly, this paper further explores the place of justice in (and its implications for) this recent scholarship on Nigeria-Biafra War past. By inserting and centralising questions of justice in the discourse of that war, we seek to rethink the assumptions of memory practice as a remedy to past atrocities in Nigeria. The underlying argument of our discussion is that not only does the emphasis on memory diminish the political nature of the conflict but also that resort to memory indicates a continued reluctance to address the fundamental questions of political in/justice in Nigeria.  相似文献

The Influence of Perceptions of Fairness on Performance Appraisal Reactions   总被引:1,自引:0,他引:1  
The success of appraisal systems may well depend on ratees’ perceptions of fairness and reactions to important aspects of the appraisal process. My primary purpose is to integrate the literatures on fairness perceptions and appraisal reactions to test specific, heretofore untested, hypotheses. Consistent with predictions of Sweeney and McFarlin’s (Organizational Behavior and Human Decision Processes 55:23–40, 1993) two-factor model, results of structural equation modeling indicated that distributive justice influenced satisfaction with performance ratings and procedural justice influenced satisfaction with the appraisal system. Results indicated mixed support for Bies and Moag’s (Lewicki, Blair, Bazerman (eds) Research on Negotiation in Organization, JAI Press, Greenwich, CT, pp. 43–55, 1986) agent-system model as procedural justice (and distributive justice) had more influence on satisfaction with appraisal feedback than components of interactional justice perceptions. The implications of my results are discussed and suggestions for future research are offered.  相似文献

This study examines women's conceptualization of the pervasive construct of organizational justice. A comprehensive four factor model was used to represent organizational justice while outcome variables were the important employee attitudes of job satisfaction, organizational commitment and turnover intentions. Structural equation modelling was used to analyse responses from 301 male and 147 female respondents. Differences were found for procedural, interpersonal and informational justices. It would appear female and male employees have differing responses to perceptions of justice. Justice had a diffuse effect for males, but not for females. For men, interpersonal justice predicted an increase in organizational commitment while procedural justice predicted a decrease in turnover intentions. For female employees, informational justice was found to increase commitment and reduce turnover intentions. The study highlights the need for all justice factors to be considered and for sex differences to be considered in future justice research.  相似文献

This article focuses on girls’ and mothers’ experiences of police and criminal justice system responses and the impact of investigation processes following reporting of child sexual abuse. Participants spoke of a lack of timely therapeutic provision and the subsequent role of female caregivers in providing support. Problems with criminal justice processes and the subsequent impact on families’ wider lives were also discussed. Findings suggest that criminal justice processes need to be better attuned to these micro level impacts and should show more sensitivity to the overall experience of children in the aftermath of sexual abuse. Implications for practice are discussed.  相似文献

This article uses Taiwan as an example to argue that reproductive justice for gay men should be conceptualised within social, legal, and political contexts. Taiwan is the first Asian country to legalise same-sex marriage, yet the law favours heterosexual couples and denies LGBTQ+ reproductive rights. Thus, Taiwanese gay men seek third-party reproduction overseas to become parents. This article exemplifies gay men's unequal conditions from a non-Western perspective. I re-examine scholarly literature on the interlocking concepts of reproductive justice, stratified reproduction, and queer reproduction to answer what reproductive justice gay men need and how their injustice position situates within and beyond the nation-state borders. Drawing on the reproductive justice framework and studies of queer reproduction, this article proposes a transnational perspective to understand queer reproductive justice through the case that elucidates the specific context of Taiwanese gay men. This article aims to make two contributions. Firstly, it reconsiders the reproductive framework from a transnational perspective to argue that gay men's reproductive justice should be conceptualised at the intersection with other dimensions of injustice. Secondly, this article suggests that the transnational approach could be applied as a critical lens for future research in queer reproduction and reproductive justice.  相似文献

In a three‐wave longitudinal survey among 293 couples, we studied the determinants of husbands' and wives' fairness judgments regarding the division of labor across the transition to parenthood. We tested predictions derived from the distributive justice framework that perceptions of fairness regarding the division of labor are affected by (a) wants and values, (b) social comparisons, and (c) procedural justice. The model was supported for wives at all waves. For husbands, wants and values and social comparisons were the main predictors of fairness perceptions. In general, the model was consistently supported across the transition to parenthood. Support was also found for the long‐term influence of the variables in the model on husbands' and wives' perceptions of fairness across the transition to parenthood.  相似文献

We investigated the interactive roles of procedural justice of the tax authority, trust in the tax authority, and identification with the nation in predicting voluntary tax compliance. Drawing from fairness heuristic theory and relational models of justice, we predicted that the relationship between procedural justice and voluntary tax compliance that has been found particularly among citizens with low (vs. high) trust in the tax authorities is restricted to citizens who weakly (vs. strongly) identify with the nation. The results of a field study with samples of Ethiopian and US taxpayers as respondents largely support our predictions. This research integrates the role of important and well-studied social psychological factors that shape voluntary tax compliance and reveals support for the hypothesis in a developing (i.e., Ethiopia) and a developed (i.e., US) nation – nations with strongly divergent tax climates.  相似文献

This paper tested a new model of employee–organization relationships (EORs) by introducing types of work–life conflict as variables leading to EOR outcomes, and by investigating the possible effects of transformational leadership, procedural justice, and family-supportive workplace initiatives upon employees’ perceptions of work–life conflict and relationships with their employers. Data were collected from a survey of 396 U.S. employees. Hierarchical Linear Modeling (HLM) was adopted to address the multilevel structure of collected data. Time-based work–life conflict, individualized consideration, and procedural justice were found to be associated with quality of EORs significantly. Fair work–life policy-making procedures also significantly predicted perceived levels of work–life conflict.  相似文献

Although we know that high‐quality employee–organization relationships are beneficial, these relationships are complex and not fully understood, especially among employees of nonprofit organizations. In particular, we know little about how these employees perceive trust, which may overlook an important contributor to effective management. We begin to address this issue by testing a new theoretical model that conceptualizes perceived insider status, psychological ownership, and organizational identification as foundations for the perception of justice and subsequent trust. Our results indicate that psychological ownership and perceived insider status relate to trust through procedural and interpersonal justice. These results contrast those typically found in for‐profit contexts in that organizational identification did not predict justice and that distributive and informational justice did not predict trust.  相似文献

We explored the moderating roles of legitimate and coercive power held by the tax authority in the relationship between procedural justice, trust in the tax authority, and voluntary tax compliance. Drawing from fairness heuristic theory and the slippery slope framework of tax compliance, we predicted that procedural justice fosters voluntary tax compliance, particularly when legitimate power of the tax authority is low and when coercive power of the authority is high. Moreover, we predicted that these interactive effects are mediated by (cognition-based) trust. Finally, we predicted that coercive power of the tax authority is positively related with enforced tax compliance. The results of a field study among Ethiopian business owners supported most predictions. This research is among the first to integrate social–psychological and deterrence-related factors to understand tax compliance behavior in a developing country.  相似文献

ABSTRACT

“Life, liberty, and the pursuit of happiness” are supposedly “certain inalienable rights” that the Declaration of Independence claims have been gifted to all human beings by their Creator, and for which the U.S. government was created to protect. The issue of violence and brutality against African American males along with the police shooting of unarmed African American males has become a reality of the denial of these rights for some in America. Recent police shooting incidents of Michael Brown in Ferguson, Missouri, and Tamir Rice in Cleveland, Ohio, in addition to the brutal murder by police of Eric Garner in Staten Island, New York, have sparked riots, looting, protests, “die-ins,” and national conversations. The subsequent civil unrest across the United States and abroad has attracted widespread public attention. In this article, three authors respond by providing a timely trilogy of uniquely diverse perspectives and viewpoints on these issues giving particular attention to (1) the view from a historical lens and Black Power political framework producing an analysis of the causative factors promoting and sustaining violence against African American males, (2) an examination of criminal justice law, and (3) a look at our way forward.  相似文献

An essential element of the restorative justice process is engagement in emotional healing, which is made possible via the ways in which offenders manage shame. Effective shame management depends in part on the operation of justice principles. While research has examined justice and the importance of emotions in facilitating the restorative justice process, further investigation is necessary to understand how various types of justice affect emotions and facilitate the restoration of offenders. This article provides an overview of major findings regarding the relationship between justice, attributions, and emotions and how these findings relate to restorative justice. This article considers the participation of social services in youth justice systems in 11 European countries. In international children's rights instruments, the importance of the assessment of the background situation of juvenile defendants is acknowledged. In this article, three models for social work participation are proposed, on the basis of the distinction between adversarial and inquisitorial legal traditions and welfare and justice approaches towards youth justice. In the welfare model, social workers play the most active role in the youth justice process, whereas in the justice model, social workers have the least active role. In between, a mixed model can be found in which social workers play an active role in the youth justice system only to some extent.  相似文献

This article begins with a discussion of the vital need for collaboration between social work and law enforcement professionals, with particular emphasis on the need for comprehensive training programs combining criminal justice and social work knowledge. It then documents several historical recommendations for training police social workers that are relevant today, and suggests that social work education programs of the future include provisions for transmitting social work knowledge to police officers. Similarly, social workers planning to practice in criminal justice settings need to have training in the administration of justice.  相似文献

ABSTRACT

This article offers a personal reflection of my journey into participatory arts-based research with sex work migrants in South Africa. It begins by sharing some background information of how my own experience as a migrant woman, and my layered (sometimes conflicted) identities, have continued to shape and influence much of my scholarly work, including my commitment to engaging in research that supports (or at least tries to support) social justice. Through this article, I offer an example of how the ‘personal is political’ is entwined in feminist values of research and engagement. Those who experience the issues under investigation must be considered equal partners in research processes. Collaborative forms of knowledge production can support social justice, particularly if efforts strive to shift the centre from which knowledge is traditionally generated and disseminated.  相似文献

Many have studied Roman Catholic clergy who have sexually abused children, but the range of investigations remains disconnected. This article brings together various disciplinary perspectives to form a comprehensive view. A review of the literature is first undertaken to comprehend how clergy offenders have been conceptualized in psychosocial, sociocultural, and moral-religious studies. These perspectives are then used as a foundation for examining how these clergy can be rehabilitated. Three rehabilitative modalities—psychological treatment, rehabilitation through restorative justice, and ritual healing—are explored. The article concludes with a discussion of the insights gained from the literature review and how the modalities can be advanced in an interdependent and considered approach.  相似文献

We hypothesized that the contingent valuation method (CVM) can enhance the procedural justice of policy formation as perceived by people generally, which in turn increases public acceptance of policy. In Study 1, a survey (n=484) asked whether respondents would accept a one-off tax, the purpose of which would be to protect the natural environment of Yakushima Island, Japan. In one condition, the respondents were told that the amount of the one-off tax was determined using the CVM. In a second condition, no such instruction was given. In Study 2, 55 subjects were asked to indicate their acceptance, or otherwise, of a one-off tax for the protection of the natural environment of Yakushima Island when the tax was determined using the CVM, and when the tax was determined using cost–benefit analysis. The data from the survey and the experiment confirmed the hypothesis that the CVM enhanced the perceived procedural justice and acceptance of the tax.  相似文献

This article examines the relationship between federal employeeperceptions of procedural justice and work satisfaction rates,turnover intentions, and the degree to which employees trusttheir managers. As the federal government considers reformingthe civil service system, including changes to the proceduresused to discipline employees and resolve grievances, understandingthese relationships becomes particularly important. Analysisof Department of Defense data from the 2002 Federal Human CapitalSurvey indicates a significant, positive relationship betweenprocedural justice perceptions, satisfaction rates, and trustin management. Likewise, a significant and negative relationshipexists between procedural justice perceptions and turnover intentions.Interestingly, given similar levels of procedural justice perceptions,managers exhibit lower levels of satisfaction and trust andhigher turnover intentions. This study provides an importantbenchmark for Defense and other agencies that are redesigningpersonnel systems and serves as a caution against implementingsystems that employees may not view as either legitimate orjust.  相似文献
