This paper compares legal approaches to foundations in six economically well-developed democracies (USA, England and Wales,
Germany, Austria, France and the Netherlands). ‘Foundations’ refers to ‘non-governmental, non-membership, organisations, recognised
as a legal category with a purpose in the general interest’. This covers the common field of the common law's charity and
the civil law's foundation as a legal person. The countries organise public supervision of foundations in very different ways.
Mostly there is governmental involvement or involvement of an independent body in the establishment and governmental supervision
of foundations in action. In a few cases, the supervisory power—concerning the foundations' activities, not their establishment—is
with judicial authorities. Access to information of foundations (registration) and possible requests for sanctions by interested
parties are also rather different. Not all rules are in accordance with the freedom of organisation and some are less desirable.
The conclusion is that a balance between the freedom of the foundation (board), the protection of the public order and the
protection of the interests of others can be found in a system with systematic supervision at the establishment- and later
practice—by governmental or independent authorities or in a system with good registration and incidental supervision by judicial
authorities, also at the request of interested parties. Both have their advantages and disadvantages. 相似文献

Both published results from the 1930, 1947, 1960 and 1971 censuses and unpublished ones are used to examine the influence that religious denomination, socio-economic group and region exerted on the fertility of marriages contracted between 1876 and 1959. A theory formulated by Lesthaeghe and Wilson on the relation between modes of production and secularization and the pace of fertility decline in Western Europe offers — in combination with van Heek's views on the special position of Dutch Roman Catholicism — a starting point for an explanation of why the fertility decline of Roman Catholics, self-employed and agricultural labourers lagged behind. 相似文献

Research on firm search stresses the need for firms to adapt and align concurrently with their environment to optimize the ability to sense and seize opportunities for sustained performance. We postulate resource scarcity as an important contingency factor for the search-performance relationship, and assess its joint influence with high and low dynamism. Using a dataset spanning 23 years, we examine the performance implications of combinations of internal and external exploratory and exploitative search in resource-scarce environments, under conditions of high and low dynamism. We find that resource scarcity is an important condition for performance stemming from exploratory and exploitative search: even under conditions that involve low dynamism, but joined with resource scarcity, firms may benefit from pursuing exploratory and exploitative knowledge simultaneously. 相似文献

A cooperative game with transferable utilities– or simply a TU-game – describes a situation in which players can obtain certain payoffs by cooperation. A solution concept for these games is a function which assigns to every such a game a distribution of payoffs over the players in the game.
Famous solution concepts for TU-games are the Shapley value and the Banzhaf value. Both solution concepts have been axiomatized in various ways.
An important difference between these two solution concepts is the fact that the Shapley value always distributes the payoff
that can be obtained by the `grand coalition' consisting of all players cooperating together while the Banzhaf value does
not satisfy this property, i.e., the Banzhaf value is not efficient. In this paper we consider the normalized Banzhaf value which distributes the payoff that can be obtained by the `grand coalition' proportional to the Banzhaf values of the players.
This value does not satisfy certain axioms underlying the Banzhaf value. In this paper we introduce some new axioms that characterize
the normalized Banzhaf value. We also provide an axiomatization of the Shapley value using similar axioms.

The prime motivation for these entities is to preserve market share and fill beds. Aspects of industrial relations and internal co-ordination have been a major topic of empirical research in the German business enterprise sector. In contrast, there are practically no empirical investigations into labour-management relations in third sector institutions. The largest share of this sector in Germany is represented by the two Christian churches with presently about 900,000 employees. According to the notion of church officials, labour-management relations in these institutions are characterised by a specific normative concept which emphasises a trustful co-operation of all employees in the mission of the church. The major concern of our research project focused on the question whether the specific conditions of employment within church institutions favour more hierarchical or more co-operative forms of co-ordination and how employees and employee representatives perceive the ideal of the community of service (Dienstgemeinschaftsgedanke). The results of our research lead to the conclusion that church labour-management relations are characterised by a remarkable contrast between the participative or co-operative notion of the ideal of the community of service and present forms of hierarchical co-ordination inside church institutions.This article gives a selected overview of Beyer and Nutzinger (1991). Assessments of occupational exposures to chemicals are generally based upon the practice of compliance testing in which the probability of compliance is related to the exceedance [γ, the likelihood that any measurement would exceed an occupational exposure limit (OEL)] and the number of measurements obtained. On the other hand, workers’ chronic health risks generally depend upon cumulative lifetime exposures which are not directly related to the probability of compliance. In this paper we define the probability of “overexposure” (θ) as the likelihood that individual risk (a function of cumulative exposure) exceeds the risk inherent in the OEL (a function of the OEL and duration of exposure). We regard θ as a relevant measure of individual risk for chemicals, such as carcinogens, which produce chronic effects after long-term exposures but not necessarily for acutely-toxic substances which can produce effects relatively quickly. We apply a random-effects model to data from 179 groups of workers, exposed to a variety of chemical agents, and obtain parameter estimates for the group mean exposure and the within- and between-worker components of variance. These estimates are then combined with OELs to generate estimates of γ and θ. We show that compliance testing can significantly underestimate the health risk when sample sizes are small. That is, there can be large probabilities of compliance with typical sample sizes, despite the fact that large proportions of the working population have individual risks greater than the risk inherent in the OEL. We demonstrate further that, because the relationship between θ and γ depends upon the within- and between-worker components of variance, it cannot be assumed a priori that exceedance is a conservative surrogate for overexposure. Thus, we conclude that assessment practices which focus upon either compliance or exceedance are problematic and recommend that employers evaluate exposures relative to the probabilities of overexposure. 相似文献

In recent years, solution‐focused parenting support has been developed and implemented as a promising brief and strength‐based approach. Given the fundamental differences between solution‐focused and the historically more common problem‐focused parenting support and the complexity of transforming professional practice, an actual shift towards solution‐focused parenting support can be expected to be limited up to now. However, because research into the specific communication characteristics of professional parenting support is currently lacking, no conclusion can be drawn at present. Therefore, this study aims to explore the current problem‐ and solution‐focused characteristics of parenting support in the Dutch youth healthcare (YH). In total, 15 support sessions performed by 10 public health nurses were audio recorded and transcribed verbatim. A detailed qualitative content analysis of professional communication was conducted to identify problem‐ and solution‐focused factual, expressive, relational and appealing aspects of parenting support. Problem‐focused characteristics dominated all sessions of parenting support. This study is the first to thoroughly analyse the problem‐focused and solution‐focused communication characteristics of professional parenting support using a qualitative content analysis. Parenting support practice in the Dutch YH did not shift substantially to a solution‐focused approach. More effort is required to stimulate and facilitate this professional transformation. 相似文献

Spatial homogamy may be defined as follows: anyone may be attracted to anyone else, but near candidates are more attractive than distant candidates. In this article, we propose a model of partner choice, where homogamy is defined in terms of spatial, demographic, socioeconomic and cultural similarity. A spatial choice model using random utility theory is formulated, taking into account a relaxation of the independence from the irrelevant alternatives property, as spatial alternatives are not independent of one another. We model partner choice given the characteristics of the chosen partner and a choice set of alternatives, using unique micro data on all new cohabiters in the Netherlands, linked to other relevant data sets. The model takes the spatial locations of potential candidates within a choice set into account, including an indicator for the spatial similarity between alternatives. We find that spatial homogamy is a vital component of partner matching, aside from and adding to the spatial effects in demographic, socioeconomic and cultural homogamy. Given a choice set of partners, the highest likelihood of a match occurs with a person who is born and lives near by, who is close in age, is in the same life stage and has the same marital status, who has the same educational and income level and the same labour market status, who speaks the same dialect and lives in a culturally similar residential area. The distance effect is most pronounced for those individuals with lower levels of education and those living in rural areas. 相似文献
