试析中国与沙特阿拉伯的石油合作

沙特阿拉伯是世界第一大原油生产国和出口国,中国是世界第二大石油消费国和消费量增长最快的石油进口国.沙特需要为其巨大的能源储量寻找新的市场,中国需要海外能源满足经济增长的需要.因此,两国在能源领域存在着相互依赖关系.正是这种相互依赖关系推动着中沙关系的稳步发展,本文力图运用政治经济学的分析法对中沙石油合作做出理性分析与判断.     

‘America’ in Indian Advertising: Change and Impact

The aims of this article are threefold: One, to focus on the advertising and marketing communications situating the presence of the USA in India. Two, to address three issues concerning the where, how, and impact dimensions of marking the US presence in Indian advertising. In that process an attempt will be made to integrate three aspects of advertising, namely: marketing, media, and linguistics. Three, to account for US corporate culture as it manifests itself in advertising. Central to our discussion are two product types: consumer products (e.g. Coke, Pepsi, Kellogg’s cereals, or Cadbury’s chocolates) and socially-sensitive, or ‘taboo’, products (e.g. condoms, alcohol, and breath fresheners).     

Macro-conditions and immigrants' happiness: Is moving to a wealthy country all that matters?

Migrants look for a better life. In what kind of country will they live happiest? Many migrants aspire to move to wealthy countries, but non-economic factors might be important as well in making a country livable for migrants. This issue is addressed here by examining the impact of macroeconomic conditions and non-economic macro-conditions (good governance and a pleasant social climate) on immigrants' happiness in twenty European nations. We find that immigrants' happiness depends both on economic and non-economic macro-conditions. The social climate is especially important, particularly in terms of a positive attitude in society towards migrants. Our findings imply that the choice of destination country matters for migrants’ happiness and that the discrepancy between migration motives and migration outcomes may constrain immigrants from maximizing subjective gains via migration.     

The construction of social work in Brazil: a study of scientific texts

This article is a review of 50 selected peer-reviewed articles from 2004 to 2013. The texts are analysed with reference to Malcolm Payne’s model of the three-way discourse of social work, and the findings are discussed in relation to Brazil’s social and political background. The review of the articles reveals a general perspective on social work in Brazil as a profession aiming at social change through collective transformation, and a normative identity of social work as a profession with political implications. The texts written in Portuguese for a Brazilian audience are more inclined to promote explicit political perspectives on social work than the English texts. Ideological concepts such as democracy and universal rights expressed in the articles are challenged by competing views in Brazilian society. This is especially the case in discussions about the role of the third sector in Brazil. Social work as a concept cannot be taken for granted. The experience of extreme inequalities that Brazil shares with several other Latin American countries makes it necessary to consider historical and social characteristics in order to understand the analytical perspectives that national and international academics employ when studying social work in Brazil.     

刑事诉讼法修正后毒品犯罪案件证据制度的完善

由于毒品犯罪案件有其特殊性,其证据的取得、认定、运用等多方面存在诸多困难。新颁布的《刑事诉讼法修正案》增加了电子证据种类,肯定了"控制下交付"的侦查措施,明确了证人出庭保护等制度,为今后查办和认定毒品犯罪案件提供新的保障,当然也提出了新问题。     

“罪名”抑或“具体犯罪行为”之析——对刑法第17条第2款有权解释的几点看法

相对刑事责任年龄的人犯罪，承担刑事责任能力与其年龄密切相关。立法上始终贯彻“以教育为主，惩罚为辅”的方针和“从宽处罚”的原则，对其承担刑事责任的范围作出了及其严格的限制规定。但如何确定犯罪的相对刑事责任年龄人承担刑事责任的范围、触犯的罪名等，在理论上还有待于进一步探讨。     

刑法第306条设置批判质疑

我国《刑法》在1997年修改之后，其第306条一直在法律界备受关注，该条规定从立法观念、特殊主体设置、条文拟制、司法平衡、审判实践及实施后果上都引起极大争议，尤其是律师界对此条规定意见颇多。在宪政背景下，公权机关仍然是公众权利的受托人或者代言人，对公权机关的无原则歧视或者攻击，就是对公民权利的另一种不尊重或者践踏。因为公权机关同样需要善待，一如公民权利需要善待一样。     

Europe’s Role in China’s Transition to Superpower Status

What can Western powers do today to ease an eventual global power shift resulting from the rise of superpowers such as China? This paper suggests that part of the answer lies in the same power-binding institutions that allowed the US to rise post WWII without threatening its allies. Continuity in the rules of the global system during a great power transition would promote stability by reducing uncertainty, as well as the extent to which material power can be used coercively. I argue that current superpowers, the EU among them, have an interest in ensuring an equitable distribution of the gains from cooperation. While distributional issues are usually treated in normative terms, they take on very real, material meaning in the context of a great power transition. With this in mind, I look at three aspects of the current global institutional framework that would benefit from reform: international trade and aid, institutional design, and institutional proliferation. In all three cases, a more equal distribution of the gains from institutions today increases the odds that those institutional arrangements will remain in the future.     

进入国际发展议程前沿的“青年”——概念、多元政策议题与优先关注目标

以往数十年，伴随当代青年发展问题的逐渐凸显和日益复杂化，国际发展议程中有关青年的政策议题和优先关注目标也处于流变之中。青年问题在国际主流发展界逐渐由边缘走向中心，而今已占据了重要的一席之地。作为在国际发展中执牛耳的政府间国际组织，联合国在倡导和推动涉及青年的国际发展战略、政策议程和干预举措上发挥了举足轻重的作用。自20世纪80年代中叶以来，国际社会有关青年发展的政策目标、议题和优先关注目标在不断拓展，这既反映了青年人及其问题的多元化和复杂化．也折射了国际决策界对这些问题认识和理解的日益深化。
