罗马法中非典型物权形态的解释方法研究——以使用权、居住权的形成史为中心的考察

在罗马法早期,使用权仅仅具有单一的使用权能而不能进行收益,居住权也不是一种市民法上的物权。但在日常实践中,人们常常会遗赠孳息出产物的使用权或者房屋的居住权,由此产生了一系列非典型的物权形态。在这种情况下,罗马法学家一方面要遵循市民法的原则,另一方面要满足民众新的需求。他们通过不同的解释方法,扩张了使用权的边界,并且赋予了居住权以物权的效力。罗马法学家对于非法定物权形态的解释的终点,正是现代物权法定的起点。     

Using the Internet to Meet Sexual Partners: Research and Practice Implications

ABSTRACT

Recent research studies suggest increasingly widespread use of Internet sexual networking sites to initiate sexual relationships among men who have sex with men. Concerns are growing in regard to use of such sites in promoting participation in higher-risk sexual activities by providing easier access to partners who are willing to participate. One such activity surrounds substance abuse including using crystal methamphetamine and is commonly termed “party and play” (PNP) during sexual encounters, particularly unprotected anal sex. Current studies indicate conflicting results on PNP and the meeting of sexual partners from the Internet. A critical examination of these studies is presented along with recommendations designed to support future scholarly inquiry.     

That Man Behind the Curtain: Investigating the Sexual Online Dating Behavior of Men Who Have Sex With Men but Hide Their Same-Sex Sexual Attraction in Offline Surroundings

This study investigates how men who have sex with men (MSM) use chat and dating sites based on theories of stigma-related offline behavior and online self-disclosure. We hypothesize that hidden MSM (those who self-label as heterosexual or who hide their same-sex sexual attraction from family, friends, acquaintances, or a female romantic partner) differ from open MSM in how they behave on gay chat and dating sites and in offline gay venues. Drawing on a survey of 12,002 MSM, we show that hidden MSM tend to mask their identity on gay chat and dating sites while avoiding offline gay venues. They also focus more strongly on online sexual activities (e.g., masturbating during online chats) when using gay chat and dating sites. However, they spend the same amount of time on these sites, and they use them to initiate offline sexual encounters as often and as fast as open MSM.

本文通过对南非、前苏联、加拿大、美国、瑞士等五个多族群国家的语言使用情况的分析,表明:语言权利是族群确立合法地位的重要手段,无论是同化策略还是多元化策略,如果是靠外力的强迫去推行,则会遭到抵制甚至造成分离,而如果是建立在自愿、自由选择的基础上,则能够加强各族群之间的交融,维护国家的稳定和睦.     

绵阳市城市化进程中的土地集约利用研究

文章在对绵阳市城市化进程和其发展水平进行探讨的基础上，以城市化与城市土地集约利用的关系为依据，运用主成分分析法对绵阳市土地集约利用进行定量评价，分析其空间差异。并在此基础上提出严格控制新增建设用地、优化城市土地利用结构等建议措施。     

The Cedar Project: Understanding Barriers to Consistent Condom use over Time in a Cohort of Young Indigenous People who use Drugs

ABSTRACT Little information exists on the use of condoms as protective barriers to sexually transmitted infections (STIs) among indigenous people in Canada. This study explores risk factors of inconsistent condom use (during consensual sex) over time among participants in the Cedar Project, a prospective cohort study of indigenous young people living in Vancouver and Prince George, British Columbia, who use drugs. Due to the serial measurements for each study subject, generalized estimating equations modeling with logit link was used to accommodate the temporal correlation within subjects. For young women, inconsistent condom use over time was predicted by having a recent STI (adjusted odds ratio [AOR] = 1.76, 95% confidence interval [CI] [1.12, 2.79]), smoking crack daily (AOR = 1.63, 95%CI [1.02, 2.61]), and having experienced recent sexual abuse (AOR = 2.07, 95%CI [1.20, 3.56]). Among young men, living in Prince George (AOR = 1.63, 95%CI [1.14, 2.39]) and daily crack smoking (AOR = 1.56, 95%CI [1.02, 2.40]) were associated with inconsistent condom use over time. Among participants who used injection drugs, inconsistent condom use was associated with smoking crack daily (AOR = 1.59, 95%CI [1.04, 2.43]) and sharing needles (AOR = 1.78, 95%CI [1.26, 2.51]). The availability and effectiveness of sexual health services must be prioritized for indigenous people, and the design of culturally safe sexual health programs requires the meaningful involvement of young indigenous people.

Locative Mobile Social Networks: Mapping Communication and Location in Urban Spaces

Abstract

This study conceptualizes the new spatial logic created by the social use of location aware mobile technologies, analyzing how mobile communities are formed by the mapping of social networks in urban spaces. It explores two main areas with the goal of understanding how locative mobile social networks (LMSNs) challenge the traditional logic of networks. First, it conceptualizes LMSNs by comparing them to (1) traditional transportation and communication networks, and (2) mobile social networks (MSNs). Second, the paper discusses potential social implications of LMSNs, such as privacy, surveillance, and social exclusion.
