中国医疗改革：道德与正义的考量

我国医疗体制改革是在中国农村和城市全面改革的大背景下进行的。中国改革取得成功的深层动因是允许个人功利的追求。这一背景也深刻影响到了医疗体制改革。医疗体制改革的重要趋向就是医院的市场化。市场化使得医院几乎成为单纯商业化运作的事业，因而市场正义成为医疗公正的取向。这是医疗改革失败的深层精神原因。走出这一困境就必须加大政府投入，使得医院从市场正义回归社会公平的正义；并在克服商业化倾向的同时，还需要有人道主义精神的重建。     

Mentoring Siblings of Gang Members: A Template for Reaching Families of Gang Members?

Mentoring has become a popular model of intervention to reduce the risk of offending, and has been proposed as an effective tool to tackle the risk of gang membership. This paper reviews the existing literature on mentoring and reports on a qualitative evaluation of a mentoring programme targeted at young people ‘at risk’ of gang membership in an English city. The study highlights important issues around these interventions. Although we found it a useful way to engage otherwise hard‐to‐reach families, important limitations remain: their potential labelling impact and their limited impact in isolation from other more ambitious measures.     

英国法官制度及其启示——关于法官职业化问题的思考

法官职业化与司法民主化是学理上所争论的焦点问题之一，二者在实践上也时常存在冲突和矛盾。法官职业化建设是中国法治进程的必然要求，更是实现法治社会的必经之路。但是，鉴于职业法官自身固有的局限性，法官职业化又不能太过绝对。在这个问题上，应该跳出要“法意”还是要“民意”的非此即彼的二元对立思维模式，一方面坚持职业化道路不动摇，另一方面也要重视利用非职业化元素为法治建设服务。     

论公平、公正、正义与平等的相互关系

公平、公正、正义和平等的意义相近，它们有着一定的内在联系和相通性，在特定的境况下，甚至可以互换或者交替使用。但从学术研究的角度来看，它们之间在不同的语境、不同的领域中，其适用对象和含义又是有区别的，或者说是各有所侧重。在很多情况下，它们之间更是一个相互缠绕的关系。     

Judging childhood

This article brings ethnohistorical inquiry to bear in exploring the certainties of Progressive Era reformers regarding the role of the state, the meaning of childhood, and the power of intervention in the lives of children, youth, and families in Butte, Montana. The author draws on the key themes of the Just Practice perspective (Finn & Jacobson, 2008)—as an organizing frame to explore assumptions and contestations regarding childhood, well-being, trouble, and intervention as expressed through primary source documents and reports of juvenile court proceedings in Butte from 1900 to 1914. Butte, a site of rapid industrialization at the turn of the last century, provides a local context in which to examine ways these certainties were asserted, negotiated, embedded, and resisted in the making of a nascent system of child welfare and juvenile justice. The historical analysis offers a foundation for critical reflection on the certainties embedded in contemporary practice with children and youth.     

《水浒传》梁山聚义性质的传播学分析

《水浒传》中梁山聚义替天行道攻打官府的运动,到底是什么性质的,古往今来争论不休。古代文人多认为是忠义行为,也有部分正统文人认为是叛逆造反;上世纪20年代开始有人提出农民革命的说法,之后这一说法成为主导,似是不易之论;到了80年代才有人开始提出流民起义、忠义之举、武侠行为、反叛法律等非农民起义的观点。基于此,从传播学的视角对学术界关于《水浒传》梁山聚义性质的研究进行了解读分析,认为《水浒传》梁山聚义性质的研究是一个假命题,由于人们的错误理解而进入《水浒传》研究的范畴,再加上我国文史不分的传统、阶级分析法的引进和政治形势使然,使得这一命题的研究俨然成了现实中《水浒传》研究的必然议题。

No place called home: the causes and social consequences of the UK housing ‘bubble’

This paper examines the key causes and social consequences of the much debated UK ‘housing bubble’ and its aftermath from a multidimensional sociological approach, as opposed to the economic perspective of many popular discussions. This is a phenomenon that has affected numerous economies in the first decade of the new millennium. The discussion is based on a comprehensive study that includes exhaustive analysis of secondary data, content and debate in the mass media and academia, primary data gathered from the monitoring of weblogs and forums debating housing issues, and case histories of individuals experiencing housing difficulties during this period. This paper is intended to provide a broad overview of the key findings and preliminary analysis of this ongoing study, and is informed by a perspective which considers secure and affordable housing to be an essential foundation of stable and cohesive societies, with its absence contributing to a range of social ills that negatively impact on both individual and collective well being. Overall, it is argued that we must return to viewing decent, affordable housing as an essential social resource, that provides the bedrock of stable individual, family and community life, while recognizing that its increasing treatment as a purely economic asset is a key contributor to our so‐called ‘broken society’.
