国家基层策略行为与社区过程: 基于南苑业主自治的社区故事

在转型的社区情境中,国家基层政府的行为是策略性的,社区居民亦陷入了权变的回应过程。文章聚焦于20世纪80年代以来政府行为的不同阶段,从中观的社区形态考察基层政府的不同策略和社区过程。政府干预、释出和旁观调控三种不同类型的行为反映了政府对于社区的态度,社区层次和事件性质是基层政府策略行为的关键自变量。文章运用拓展性个案研究方法,分析了国家在社区的基层策略,以及转型期社区的生成和发展,基层政府行为与社区回应的不同逻辑是社区治理困境的重要根源。     

It's a long way to Auchterarder! 'Negotiated management' and mismanagement in the policing of G8 protests

Recent analyses of protest policing in Western democracies argue that there has been a marked shift away from oppressive or coercive approaches to an emphasis on consensus based negotiation. King and Waddington (2005) amongst others, however, suggest that the policing of international summits may be an exception to this rule. This paper examines protest policing in relation to the 2005 G8 summit in Gleneagles, Scotland. We argue that 'negotiated management' cannot be imported wholesale as a policing strategy. Rather it is mediated by local history, forms of police knowledge and modes of engagement. Drawing on interviews and participant observation we show that 'negotiated management' works best when both sides are committed to negotiation and that police stereotyping or protestor intransigence can lead to the escalation of any given event. In closing we note the new challenges posed by forms of 'global' protest and consider the implications for future policing of protest.

在市场经济较为成熟的国家,劳资双方均有较规范的行动形式如罢工、闭厂等,我国的产业行动更多的是以群体性事件的形式出现的。转型时期罢工等产业行动是客观存在的现象,因此,我们应借鉴西方国家的产业行动立法,完善相关立法。同时,为避免其影响经济发展和社会稳定,必须从斗争主体、目的、程序和方式等方面对其进行法律规制。     

十年来中国抗争运动研究评述

上世纪90年代以来,中国的抗争运动爆发的频度和影响力不断增长,吸引了越来越多研究者的关注,海内外关于这一题域的研究也日渐兴起。这一研究题域在概念谱系上呈现出多元化的状态,以过程分析、结构分析和机制分析作为其主要的分析路径,以集体行动、日常抵抗、社会动员以及政治过程等理论为指导,并特别关注抗争运动与民主政治的关系;在研究方法上,规范性实证研究的比例正在上升,定量研究和比较研究是未来的发展方向。

Social Protest and Self-Enhancement: A Conditional Relationship

Data from a panel study are used to test the theoretically informed hypothesis that participation in social protest activities in the seventh grade has self-enhancing outcomes in the ninth grade and in young adulthood where the subjects in the seventh grade express alienation from the conventional social order. However, participation in social protest activities in the seventh grade is expected to have self-devaluing consequences in the ninth grade and young adulthood where the subjects in the seventh grade do not express alienation from the conventional social order. The results of OLS multiple regression analyses with interaction terms were consistent with the hypothesis. As predicted, among subjects who rejected the idea that one can get ahead by working hard, seventh grade social protest was inversely related to self-derogation; and, among subjects who affirm the idea that one can get ahead by working hard, social protest activities were related to higher subsequent levels of self-derogation.     

审判独立与抗诉监督制度的完善

司法公正需要审判独立和对审判权实施监督两方面的共同支撑。根据我国的政治体制和司法现状,检察权对审判权的监督必不可少,检察监督与审判独立之间既相互冲突又相互统一。在改造抗诉监督制度时,必须坚持“不损害独立审判权”的底线,把抗诉理由的标准由“确有错误”修改为“认为有错误”,把抗诉范围限定在“损害国家利益和社会公益”的案件和“适用法律错误”的案件,并对抗诉期间和抗诉次数作出严格限制以维护审判结果的终局性和权威性。     

Social movement in stages: a reply to Shultziner and Goldberg

This paper is a reply to Doron Shultziner and Sarah Goldberg's article The Stages of Mass Mobilization: Separate Phenomena and Distinct Causal Mechanisms. The article recognizes the theoretical contribution of the study, in particular the re‐introduction of the largely neglected stage approach in social movement studies. It then raises two major concerns related to how the authors narrow their approach to single episodes of mass mobilization and how definitively they distinguish movement stages.
