地下钱庄并非规范的法律概念,我国对地下钱庄法律价值的判断是基于其组织的非正规性而非其行为的违法性,对地下钱庄行为更多地是借助刑法规制和执法严惩而非制度规范和监管指引。以刑法与经济法互动为视角,对地下钱庄所从事的三类主要业务进行具体分析,对相关法律法规予以细致梳理和客观评价,并结合我国金融生态环境和地下钱庄行为特点提出相应的立法建议和防控对策。提出在治理地下钱庄的过程中应当做到经济法规制在前、刑法惩治在后,监管在前、执法在后,宽严相济、疏堵结合。 相似文献

凯恩斯的宏观经济理论既不涉及现实的政治维度,也不关注微观经济层面的资源配置效率问题,这样的理论应用于现实的结果很可能是弊大于利。作为应用凯恩斯理论的总需求管理思想的产物,中国4万亿的经济刺激计划在政治层面难以避免寻租和腐败、政治权力固化等问题,在经济层面有可能导致资源配置的扭曲。虽然政府出台了各种监管措施以预防这种可能出现的弊病,但经验和理论都告诉我们这些措施的有效性是有限的。 相似文献

在目前中国经济创新驱动转型的时代,企业对员工个人创新行为的依赖度越来越高.文章基于11家企业184名被试的问卷调查数据,采用结构方程分析方法,探索员工不同的目标取向通过隐性知识共享行为对创新行为的影响机制.研究结果表明,学习目标取向对隐性知识共享行为产生正向影响;绩效证明取向对隐性知识共享行为产生正向影响;绩效回避取向对隐性知识共享行为的影响效果不显著;同时,隐性知识共享行为对员工创新行为有显著影响,目标取向通过隐性知识共享行为对员工创新行为起间接作用.该研究结论进一步拓展了隐性知识共享行为在目标取向和员工创新行为中间接作用的研究领域,也为创新驱动型组织建设提供理论指导依据. 相似文献

Most of the studies on the determinants of individual gambling behaviour rely on cognitive theories. In our study, we argue that, besides cognitive factors, several social factors might play an important role as well. We analyse data from an ad hoc webmail survey conducted on about 2000 undergraduate students enrolled in a large public university in the Northern Italy in the academic year 2012–13. Using a variety of statistical techniques (standard regression models, boosted regression trees and structural equations models), we show that social variables affect both participation in gambling in the past year and latent gambling propensity. In particular, controlling for several proxies for individual cognitive ability and understanding of probability, gambling propensity is positively affected by the degree of gambling in the social surrounding (parents, peers, neighbourhood) and the acceptability of gambling activities to the individual. Moreover, in our sample of college students the role of social factors appears to be larger than that of cognitive factors, and this is consistent across different types of models and specifications. 相似文献

For a fixed positive integer k, limit laws of linearly normalized kth upper order statistics are well known. In this article, a comprehensive study of tail behaviours of limit laws of normalized kth upper order statistics under fixed and random sample sizes is carried out using tail equivalence which leads to some interesting tail behaviours of the limit laws. These lead to definitive answers about their max domains of attraction. Stochastic ordering properties of the limit laws are also studied. The results obtained are not dependent on linear norming and apply to power norming as well and generalize some results already available in the literature. Physical restraint is used in inpatient services for people with intellectual disabilities as a way of holding a person to avoid injury. This article uses data from an ethnographic study in a locked unit in the north of England to explore women’s experiences of physical restraint using a feminist disability studies analysis. Data consists of field notes as well as interviews with 16 of the women who had experienced restraint, and 10 staff who worked with them. The women gave insights into the gendered phenomenon of restraint in light of their past experiences of violence. The authors argue that restraint is used with women to encourage passivity at times when more relational and therapeutic methods could be used. The article offers recommendations for alternative strategies that services can encourage. 相似文献

The impact of youth prisons and other repressive measures is subject to public and scientific debates for years. The meaning of individual agency has, however, been largely neglected in the context of understanding processes of desistance among juvenile inmates. This text addresses differences in perceiving the institutional setting, interrelations with other inmates and the authorities as well as participation in educational training. Based on a larger study of qualitative, retrospective interviews in German youth prisons, three exemplary cases are presented illustrating different developments during incarceration. Overall, three cases document several obstacles and requirements that are supportive in the individual process of developing agency, rethinking prior behaviour and maintaining modified ways of behaviour. The three cases also provide some explanations why many young inmates maintain delinquent behaviour. 相似文献
