社会信任对公司违规的抑制性研究

如何防范公司违规、保护投资者利益是资本市场研究的热点问题。以2010-2017年沪深两地A股2853家上市公司为研究样本,基于部分可观测的Bivariate Probit模型的实证结果显示：公司所在地区的社会信任水平越高,其违规倾向越低,被违规稽查的概率则越高;进一步研究发现,风险喜好型高管会降低社会信任对公司违规倾向的抑制作用,并在一定程度上强化了社会信任对公司违规稽查的影响力度;此外,相较于信息披露违规,社会信任对经营违规倾向的抑制作用更为显著,并且更为有效地提高了经营违规被稽查的概率。     

工程项目中业主初始信任对合作的影响研究:承包商公平感知的中介作用

基于工程项目临时性社会网络组织的本质特征,从社会交换的视角,通过理论分析构建了以业主初始信任为前因、承包商对于合同的公平感知为中介、合作为结果的概念模型,并以68个财政投资项目为样本采集到162套有效数据,运用结构方程模型的方法进行实证检验。研究表明:业主初始信任对于承包商公平感知的形成具有显著的正向影响;承包商的程序公平正向影响其分配公平,二者均对合作具有显著的正向影响;承包商公平感知在业主初始信任与合作之间起到部分中介作用。     

论我国社会资本的重建

中华文化源远流长 ,社会资本积累深厚 ,为我国社会发展提供了原动力。但随着市场经济的深入 ,信任规则失范、职业道德沦丧等问题日益突出 ,不断侵蚀着信任、合作等社会资本的根基 ,不能不引起全社会的关注和忧虑。社会资本亟需重建 ,它的重建应从存量和增量两方面入手 :一方面对存量社会资本进行扬弃 ,剔其糟粕 ,吸其精华 ;另一方面 ,开发和吸收现代意义的社会资本 ,增加开放性的、大范围的社会资本。当然 ,社会资本重建需要良好的制度环境作其支撑 ,缺乏制度化支持的社会资本是脆弱的。     

当代西方经济社会学信任研究的新视野——科尔曼关于信任的研究

当代西方新经济社会学家科尔曼独辟蹊径,对“信任”问题展开一种“综合研究”。他认为,交易中的信任行为虽是一种风险行为,但却是一种有目的的理性行为,其目的是获得利益的最大化,因而应“给予信任”。信任还是一种特定的社会资本形式,它基本上是无形的,表现为人与人的关系,它具有不可让渡性、互惠性、可再生性和公共产品性。     

公正如何转化为公信

司法公正与公信是一种互动的关系,形成二者之间良性互动的关键是沟通法官与民众对于公正的理解,使纸面之公正转化为民众所认可的公正。法院的职能定位是司法公正转化为公信的关键,平衡法院的出世与入世、法官的主动与被动、规则之治与纠纷解决、精英治理与民众参与等四个方面,探讨如何沟通法院与民众对于公正的理解,使公正转化为公信。     

中日实现心灵和解,共同创造东亚未来

在经济全球化背景下,掀起的东亚次区域经济合作热潮,只有在政治互信基础上,才能建立起平等互利的区域经济合作。这关键在于日本政府能否"以史为鉴,面向未来",建立起中日双方互动友好关系,最终实现共赢。     

Social capital online: Collective use of the Internet and reciprocity as lubricants of democracy

This article puts the democratic potential of using the Internet into perspective through an analysis of how collective uses of the Internet promote social capital. Research results reveal that social capital online (i.e. trust and reciprocity) is enhanced by involvement in collective use of the Internet such as participation in online communities and use of the Internet among informal groups in everyday life. This process could counter negative aspects of Internet use. Further, accumulated online social capital can be a powerful predictor of online political participation, i.e. online reciprocity has a positive effect on intention to participate in online civic discussion. Finally, the authors' analyses indicate the possibility of a spillover of online social capital into offline arenas. It is concluded that collective use of the Internet can be a lubricant for democracy.     

'Dealing With It': Experiences of Young Fathers in and Leaving Care

The interface between two major UK Government priorities—reducingunwanted teenage pregnancies and supporting teenage parents,and improving the health and well-being of young people in andleaving local authority care—has been the focus of recentresearch. The overall aims of this study were to explore factorscontributing to early pregnancy and parenthood among young peoplein and leaving local authority care; to determine the kindsof support available to these young people; and to identifywhat enables or prevents the delivery of the support they need.Via in-depth interviews, and in four contrasting geographicalareas, data were collected from young people and service providersacross England. This paper analyses data of relevance to theexperience of young fathers who have been looked after—toconsider how the needs of these young men might be better addressedthrough policy and practice. In-depth interviews conducted withyoung fathers and service providers highlighted three key aspectsof their experience that must be addressed if future needs areto be better provided for. These are: social exclusion, trustand more flexible forms of service provision. The implicationsof these issues for future policy and programme developmentare discussed.     

“情本”与“情空”——《红楼梦》诸艳的宗教修养与宝玉出家的对比性研究

佛教中涅般木解脱目标的基础,是出离心和大悲心。以此为切入点,文章旨在探讨红楼诸艳的宗教态度和佛学修养,及其与宝玉参禅悟道、出家解脱的联系和差异性。宝玉出家体现了与佛教原始宗旨较为接近的修行理念,与其相呼应的,是有小乘气息的惜春,红楼诸艳中大多数人的学佛态度,并非真正的宗教浸润,而是士大夫式的佛学文化与禅悦。     

司法权威与裁判文书的论证改革

司法不仅能定纷止争,还可稳定社会。但司法目的的实现要依赖司法权威,而裁判文书又是司法权威的最终载体,因此司法要使人信服,就必须加强裁判文书的论证力。针对现行裁判文书模式与实践,认为应从证据和事实、裁判理由、法律适用这些方面强化论证。
