上海自贸试验区负面清单转化为全国负面清单的路径和措施

目前,在中国(上海)自贸试验区的各项实施制度中,"负面清单"制度是其中重要的一项,也将是未来自贸区可复制、可推广的一项关键制度。对此,可借鉴《美国双边投资协议2012年范本》,将上海自贸试验区负面清单转化为全国负面清单,向全国推广。     

从电影《2012》到"新灾变时代"——从气候变迁史解读"世界末日"问题

电影《2012》演绎的板块快速移动，引起世界范围内的毁灭性灾难其实是不科学的。古今所谓“世界末日”观念，均无科学依据。全新世以来，古气候发展有四个主要阶段，并具有2500-3000年的周期，先后分别是前北方期一北方期、大西洋期（黄金时代）、亚北方期（灾变时代）、亚大西洋期（新黄金时代）。目前，亚大西洋期接近结束，一个新灾变时代即将到来，并将对世界气候环境造成不可估量的重大影响。我国东部季风环流势必遭受干扰，西部干燥化将加强。     

School-level policies and the efficiency and equity trade-off in education

This paper identifies the relationship between pupils’ Family Background, their mathematics scores, and school-level policies, using the 2012 Programme of International Student Assessment for Italy and multilevel modelling. School-level policies have played a leading role in recent school reforms in many countries, but there is no straightforward empirical evidence for how they affect pupils’ outcomes and the equality of educational outcomes. Our findings show that that only some school policies intensify the Family Background Effect – (educational equity) and affect student outcomes (educational efficiency) simultaneously. We find that competitive schools are able to screen students by selecting higher socio-economic status parents, which mainly harms equity without having much effect on efficiency. There are some policies which allow some trade-off between aforementioned objectives, mainly policies related to management schools.     

From mood to movement: English nationalism,the European Union and taking back control†

This article considers whether the 2016 EU referendum can be perceived as an English nationalist movement. Specifically, attention is given to examining how memories of the former British Empire were nostalgically enveloped in anxieties regarding England’s location within the devolved UK state. The comments and work of Enoch Powell and George Orwell are used to help explore the link between nostalgia and anxiety in accounts of English nationalism. Despite their opposing political orientations, when considered together, it is argued that both men provide a unique cross-political perspective on Englishness, empire and nostalgia. By way of exploring these themes in relation to the EU referendum, Aughey’s assertion that English nationalism can be perceived as both a “mood” and “movement” is used to highlight how a sense of English anxiety regarding its lack of national sovereignty (mood), as well as a desire to reclaim this sovereignty by renegotiating trade relations with the “Anglo-sphere” (movement), were conjoined in the popular referendum slogan, “take back control”. In conclusion, it is argued that the contextualization of the referendum can be predicated upon an orientation to empire that steers away from glorifying pro-imperial images of England/Britain, towards a more positive and progressive appropriation of the EU referendum as a statement of national change and belonging.     

Gender and Infrastructure in the World Bank

This article conducts a critical analysis of the World Bank's current infrastructure strategy from a feminist perspective, arguing that failures to define gender and set meaningful targets and indicators have meant that gender has not been integrated into the implementation of infrastructure projects. It sets out three limitations to the Bank's approach to gender and infrastructure: lack of awareness of gender in the four sectors that comprise infrastructure; the Bank's narrow approach to gender equality and women's empowerment; and the failure of the Bank to mainstream gender in its current infrastructure strategy.     

2012—2013年渤海史研究评述

渤海国的历史,作为中国东北史的一个重要内容,一直备受国内学术界的关注。2012—2013年渤海史研究的成果十分丰富,且多有创新之作,在渤海史研究领域中具有特殊的意义。值得关注的研究成果是金石柱、李东辉的《地理学视角下的渤海史研究》、蒙古学者阿·敖其尔勒·额尔顿·宝力道的《蒙古境内的渤海考古学文化遗存》、程妮娜的《唐朝渤海国朝贡制度研究》、郝庆云和魏国忠的《渤海韩辐再厘定》等。     

Revival and Development of the Criminal Reconciliation System in China

Abstract

随着和谐社会治国方针的提出与宽严相济刑事政策的深化, 中国刑事和解制度呈 现出不断拓展的态势。2012年新?刑事诉讼法?以“特别程序”编的形式, 专章规定 了“刑事和解”, 第一次在?刑事诉讼法?中全面确立了中国式的刑事和解制度。但就 目前立法来看, 刑事和解程序设置还相对粗放, 也存在诸多争议。刑事和解未来发展 方向应当强化规则性完善与制度性建设。

With the adoption of the governance policy of a harmonious society and with the further strengthening of the criminal policy of mitigating severity with leniency, China’s criminal reconciliation system is undergoing rapid development. In the 2012 Criminal Procedure Law of the People’s Republic of China, criminal reconciliation is stipulated in a separate chapter under “Special Procedures,” thereby comprehensively establishing for the first time a criminal reconciliation system with Chinese characteristics in the Criminal Procedure Law. However, China’s legislation on criminal reconciliation remains relatively broad-brush and controversial. Improved regulation and system construction now point the way for future development.     

影响学生参加数学课外补习的因素——以中国上海和日本大都市为例

选取PISA2012数据，采用logit模型和HGLM模型研究影响中国上海和日本大都市学生参加数学课外补习的因素。研究发现：影响两个国家（地区）学生参加数学课外补习的因素主要为学生层面的因素，具体而言，女性的数学课外补习参与率高于男性，独生子女学生数学课外补习参与率高于非独生子女学生；ESCS和家庭教育资源充裕程度对学生参加数学课外补习有正向预测作用；数学成绩对数学课外补习参与的影响不确定。     

Adjusting for centre heterogeneity in multicentre clinical trials with a time‒to‒event outcome

Conducting a clinical trial at multiple study centres raises the issue of whether and how to adjust for centre heterogeneity in the statistical analysis. In this paper, we address this issue for multicentre clinical trials with a time?to?event outcome. Based on simulations, we show that the current practice of ignoring centre heterogeneity can be seriously misleading, and we illustrate the performances of the frailty modelling approach over competing methods. A special attention is paid to the problem of misspecification of the frailty distribution. The appendix provides sample codes in R and in SAS to perform the analyses in this paper.
