我国地方立法权随着2015年《立法法》的修改扩至所有设区的市,随之掀起地方立法热潮。但目前地方立法的质量普遍不高,存在诸多问题,人工智能技术的应用能为地方立法开辟新路径。基于互联网及大数据的人工智能,能被应用于资料检索、立项论证、立法公开与意见征集、辅助草案起草、立法后评估与备案审查。与此同时,当人工智能被应用于地方立法工作时,需要确立“辅助原则”,规范人工智能地方立法程序的选用标准,限制人工智能地方立法程序的算法,以此来规制人工智能带来的不利影响。 相似文献

在中华民族“多元一体”背景下,加强各民族交往交流交融,是铸牢中华民族共同体意识的必然要求。而通过科学立法建立完备的法律规范体系,则是运用法治思维和法治方式,促进各民族交往交流交融的根本前提。当前我国的民族法律规范体系虽已基本建成,但仍存在一些法律原则的表达不够严谨、法律概念的界定不够准确、法律规则的内容不够明晰和完整、规范体系的结构不够完备和和谐等缺陷和不足,难以满足在政治、经济、文化、社会和生态建设中通过法治方式有效协调民族关系,促进各民族交往交流交融的需要。这就要求立法者应遵循《立法法》确定的科学立法的形式合理性和实质合理性的要求,妥善处理法律规范体系与现实需要的适应性和可执行性,由此才能为通过法治促进各民族交往交流交融奠定坚实的制度基础。从科学立法与依法立法、民主立法的关系来看,遵循依法立法,是保障法的形式合理性的前提;坚持民主立法,则是保障法的实质合理性的根基。为提升立法的科学品质,必须健全违宪审查机制、协商民主机制和立法理论形成机制,确保依法立法、民主立法原则的有效落实。 相似文献

Research on problemistic search has assumed negative attainment discrepancy to be the trigger of both local and distant search. Extending this research, we present and compare two additional triggers: (1) relative attainment discrepancy, which reflects how much a firm's attainment discrepancy deviates from its past negative attainment discrepancies; and (2) persistent attainment discrepancy, which reflects how often the firm experiences below-aspirations performance. Our triggers for distant search model a behavioral explanation for the timing and relatedness of acquisitions. We find support for baseline arguments of problemistic search whereby firms increase both industry- and skill-related acquisitions when they perform below aspirations. When they persistently perform below aspirations, however, this likelihood is reduced and firms engage in acquisitions that are more unrelated, thereby providing support for the notion of expanding search boundaries from local to distant search. Of the two triggers of distant search proposed, relative attainment discrepancy does not induce firms to expand search boundaries. Our results indicate that persistent attainment discrepancy is a key construct to consider when studying the expansion of search boundaries. 相似文献

This study examines an overlooked dynamic in sociological research on greenhouse gas emissions: how local areas appropriate the global carbon cycle for use and exchange purposes as they develop. Drawing on theories of place and space, we hypothesize that development differentially drives and spatially decouples use- and exchange-oriented emissions at the local level. To test our hypotheses, we integrate longitudinal, county-level data on residential and industrial emissions from the Vulcan Project with demographic, economic and environmental data from the U.S. Census Bureau and National Land Change Database. Results from spatial regression models with two-way fixed-effects indicate that alongside innovations and efficiencies capable of reducing environmentally harmful effects of development comes a spatial disarticulation between carbon-intensive production and consumption within as well as across societies. 中国的劳动立法开始于20世纪20年代的北洋政府时期。这一时期,迫于工人运动的压力,政府相继出台了工厂法、矿山交通劳动法、工会组织法、劳工福利法等方面的法规。这些劳动立法,从理论和制度层面上来讲是一大进步。然而,北洋政府制定劳动法规的根本目的是为了抑制工人反抗,调和劳资矛盾,维护统治秩序,并未想从根本上改变劳工的劳动和生活状况及其社会地位。因此,北洋政府时期劳动立法的实施成效欠佳,其制度的建设意义远大于对工人保障的实际意义。 相似文献

The article focuses on the contribution of the European Union (EU) in promoting sustainable development through the involvement of civil society in partner countries. More specifically, it analyses the main features and outcomes of the projects implemented by civil society organizations (CSOs) in Kyrgyzstan under the EU thematic programme Non‐State Actors and Local Authorities in Development (NSA/LA). Despite its importance—this is the only EU programme providing direct support to non‐state actors and local authorities engaged in poverty reduction—to date, there has been very little research on the functioning of this instrument on the ground. This article seeks to fill this gap in the literature by examining the EU’s contribution to sustainable development through a case study on Kyrgyzstan. The study is based on primary data: 10 semi‐structured interviews conducted with the EU‐funded organizations implementing the NSA/LA programme. The NSA/LA projects were analysed by considering two major fields of engagement of non‐state actors in the development process: as service providers and as advocates (Banks & Hulme, 2012). Overall, the organizations awarded EU support were not only focused on fulfilling short‐term needs but also sought to introduce new ways of dealing with poverty and inequality, positioning themselves between the “Big‐D” and the “little‐d” approaches to development (Bebbington, Hickey, & Mitlin, 2008). Nonetheless, the EU‐funded projects were too limited and fragmented to be able to sustain long‐term structural change. Therefore, the EU should place new emphasis on creating synergies between new and old structures at the grassroots level and establishing mechanisms and bodies that could merge and co‐ordinate their efforts. In addition, the calls for proposals could highlight the need to share the lessons learnt by “obliging” the beneficiaries to act as multipliers and to pass on their positive experience to neighbouring communities. Finally, the EU could stimulate the funded organizations to experiment with innovative mechanisms of involvement in the policy‐making process, by making this aspect a mandatory requirement of the projects implemented with its support. 相似文献

In this article, we propose a general class of partially linear transformation models for recurrent gap time data, which extends the linear transformation models by incorporating non linear covariate effects and includes the partially linear proportional hazards and the partially linear proportional odds models as special cases. Both global and local estimating equations are developed to estimate the parametric and non parametric covariate effects, and the asymptotic properties of the resulting estimators are established. The finite-sample behavior of the proposed estimators is evaluated through simulation studies, and an application to a clinic study on chronic granulomatous disease is provided. 相似文献

This article focuses on the conditional density of a scalar response variable given a random variable taking values in a semimetric space. The local linear estimators of the conditional density and its derivative are considered. It is assumed that the observations form a stationary α-mixing sequence. Under some regularity conditions, the joint asymptotic normality of the estimators of the conditional density and its derivative is established. The result confirms the prospect in Rachdi et al. (2014) and can be applied in time-series analysis to make predictions and build confidence intervals. The finite-sample behavior of the estimator is investigated by simulations as well. 相似文献
