Twitter,incivility, and presidential communication: A theoretical incursion into spectacle and power

ABSTRACT

By approaching civility as an operational logic for democracy, we ask how incivility is a strategy related to power and domination, particularly from the president of the United States. We propose that Twitter is part of an infrastructure of incivility, through which structures and discursive mechanisms contribute to a devaluation of normative democratic discourses. Spectacle provides a theoretical framework to contextualize the forces at play in mediating our relations. Using President Trump’s Twitter use as a case study, we offer four propositions that together formulate a framework for theorizing the strategic use and deployment of incivility as an increasingly legitimate, yet problematic tool for democratic governance.     

“通知—删除”规则在电子商务专利侵权中的适用——兼论《民法典》第1195条

随着电子商务的蓬勃发展，“通知—删除”规则在有效制止电子商务专利侵权中具有重要作用。我国在21世纪初引进“通知—删除”规则，逐步构建了适用于电子商务领域专利侵权的“通知—删除”规则。《民法典》正式施行以来，“通知—删除”规则在适用于电子商务专利侵权中暴露出诸多问题：存在规则滥用隐患，权利人与商家利益失衡，通知与反通知的审核标准难以一致，因错误通知造成商家损失难以恢复，等等。解决好这些问题，需从专利侵权的特殊性出发，贴合《民法典》第1195条的规定，遵循“通知—删除”规则的立法目的进行解释适用；应重视和探索电子商务平台的自治能力，推动“通知—删除”规则在电子商务专利侵权中的解释适用。     

铁路站前框架式挡土型高架结构规划设计

连接铁路客站落客平台和周边道路的高架结构以梁式桥居多，宁杭高铁湖州站的站前北接线高架由于道路线形、建设工期、与客站地块衔接等原因，部分区段采用框架式挡土型结构。采用框架结构初步拟合、路面基层二次找坡、道路面层修正的三步骤方法拟合道路线形；采用箱涵式挡土墙为管线及人员检修预留空间，同时在挡土墙内底填充素混凝土以满足挡墙稳定性要求；在挡土墙的外侧顺道路方向设置钢筋混凝土墙体，增加结构的侧向刚度、改善结构受力；在结构与高填土路基段的交界区域，设置了搭板缓解路面差异沉降，并设置伸缩缝改善车辆行驶的平顺性。可为类似工程提供参考。     

基于消费者显著性偏好的双边平台转换成本和定价策略研究

针对消费者对转换成本和价格属性具有显著性偏好的实际情况，基于显著性理论对垄断双边平台企业的转换成本和定价策略问题进行了研究。研究发现：1)在显著性偏好非对称型市场上，对价格敏感的一方收取的价格最低，对高转换成本的一方收取的价格最高，而在显著性偏好对称型市场上，平台的最优价格位于非对称型市场之间，但是对价格敏感型市场收取的价格低于转换成本敏感型市场的价格。2)在高转换成本的市场，平台利润最低；低转换成本市场平台利润最高，而混合型情况的最优利润位于这两者之间。该研究结论说明平台企业应该采取措施来降低用户加入平台的转换成本，从而增加利润，这与现实的案例研究结论相吻合。     

构建民办高校学生党建微博平台的思考

微博作为新媒体领域的一个重要平台，已经渗透到高校学生学习、生活的各个方面，其教育载体的属性已然显现。然而，目前民办高校学生党建微博平台的建设尚处于起步阶段。民办高校应充分认识构建学生党建微博平台的必要性，探索其可行性路径，思考其深层次问题，不断提高学生党建平台建设的现代化水平。     

电子商务平台吸附能力的影响机制研究———平台柔性和控制机制的交互效应

平台型电子商务已经成为未来经济发展的主要推动力,如何构建并应用这种平台商务模式已经成为企业管理者普遍关心的问题.然而现有文献对电子商务平台的研究还比较少,主要基于平台主体的案例研究,缺乏从平台商家角度对如何形成电子商务平台的吸附力并激发网络效应的实证检验.基于模块系统理论和控制机制的相关文献,提出了平台柔性、平台控制、以及二者交互作用对平台吸附能力的影响模型.通过对185家平台参与企业的实证研究,研究结果显示平台柔性、正式控制、和关系控制均显著影响电子商务平台吸附能力;另外,平台柔性和正式控制对电子商务平台吸附能力的形成存在替代效应,平台柔性和关系控制对电子商务平台吸附能力的形成存在互补效应,正式控制和关系控制对电子商务平台吸附能力也存在互补效应.研究发现,对于模块系统理论和控制机制的应用情景进行了扩展和延伸,也为电子商务平台的管理者提供了有益的建议.     

Regulation and the future of work: The employment relationship as an innovation facilitator

Digital transformation and the reorganization of the firm have given rise to new forms of work that diverge significantly from the standard employment relationship. Advocates of digital disruption suggest that the existing legal framework cannot accommodate “innovative” working templates and business models. This article, however, argues that labour regulation can continue to facilitate innovation, presenting the employment relationship as a flexible instrument, and standard forms of employment as the means of achieving efficiencies and cost advantages. First, they allow for the full exercise of managerial prerogative and attendant internal flexibility in workforce deployment, and, second, they constitute an effective device to deliver training and develop skills.     

The red and the black: China’s social credit experiment as a total test environment

China's social credit system is an unusually explicit case where technology is used by multiple actors to turn human behavior into a test object on behalf of the state's goal of modifying the larger social environment, making it an intriguing setting for thinking about the new sociology of testing. This article considers how China's search for a usable “credit” score to both allocate financial resources and explicitly measure a citizen's trustworthiness creates an emergent experimental system of governance similar to, yet not quite captured by, the kinds of experimental processes observed in literature on the platform as a form of market-based governance. As a site where “seeing like a state” and “seeing like a market” converge, the social credit system is a vantage point for observing the changing relationship between moral and economic domains in an era of digital platforms. The article highlights the experimental quality of the system and its emerging system of governance structured around reward and punishment and argues that strategic ambiguity, institutionalized through the affordances of digital platforms, is an important part of the design of this large-scale social experiment.

隔水管系统足海洋钻井的主要设备之-本丈对描述隔水管运动的四阶非线性偏徽分方程和边界条件进行了简化，并应用有限差分法对隔水管的受力情况进行数值分析.作用在隔水管上的顶张力，使用四种海况进行研究，并编制了相应的计算程序.通过实例计葬，与美国应力工程服务奋司的计葬结果进行比较，结果完全-致.末文提供的动态分析方法及计葬程序具有方法简便、精确度高和机时省千优点，对设计和校核隔水管系统具有实用价值.     

风险控制对众包创新模式有效性的杠杆作用研究

随着"互联网+"在各个领域的广泛应用,众包创新平台应运而生。众包创新作为协同创新的一种模式,基于互联网平台为企业提供创新服务,可以有效提升企业核心竞争力。基于风险感知理论与风险控制相关文献,从平台风险控制角度,以猪八戒众包创新平台为例,采用数据挖掘技术获取平台一手数据,利用层次回归模型研究风险控制机制对众包创新平台有效性的影响。研究发现:通过建立接包方服务绩效评价体系与平台功能风险控制(保证金及接包商信誉评级)可以降低发包方对众包创新的感知风险,从而增强众包创新平台有效性。在两种风险控制机制的交互作用下,平台的有效性会得到进一步提升。此结论有助于众包创新平台运营及服务监管,促进平台交易环境向正规化、有序化方向发展,提升平台竞争力。
