《电子商务法》视角下网约车平台的信息披露义务

近年来网约车平台的信息管控问题受到较多关注。网约车属于服务提供型电子商务平台，具有更强的人身安全保障需求，以区别于以实物商品为交易标的的商品提供型电子商务平台。网约车平台对于服务提供过程中的驾乘信息有强大的管控能力，同时也需承担承运人责任。《电子商务法》为电子商务平台直接或间接设定了信息披露义务，在《电子商务法》未明确规定或仅做原则性规定的情形下，网约车平台亦应当根据实际情况将相应信息做单独处理以满足乘客、利益相关人和国家机关合法的信息披露要求。在一般情况下，网约车平台需向一般公众提供平台信息与平台内经营者信息，特别是法律要求的基本信息，而在特殊情况下，网约车平台不仅需要提供相应个人信息与运营信息，还需满足披露质量上的即时性和全面性要求。

证据交换制度作为民事诉讼的一项重要制度有其自身的发展历程,从而显示了其重要的意义,并得到了各国的重视。我国也建立了民事诉讼证据交换制度,但仍存在着很多缺陷,所以有必要对我国的民事诉讼证据交换制度进行完善。     

A theoretical basis for perturbation methods

In this paper we discuss a new theoretical basis for perturbation methods. In developing this new theoretical basis, we define the ideal measures of data utility and disclosure risk. Maximum data utility is achieved when the statistical characteristics of the perturbed data are the same as that of the original data. Disclosure risk is minimized if providing users with microdata access does not result in any additional information. We show that when the perturbed values of the confidential variables are generated as independent realizations from the distribution of the confidential variables conditioned on the non-confidential variables, they satisfy the data utility and disclosure risk requirements. We also discuss the relationship between the theoretical basis and some commonly used methods for generating perturbed values of confidential numerical variables.     

论公司法上的自我交易

对于自我交易,各国公司立法确立了比较完备的实体规规和相应有效的救济程序,而我国现行的《公司法》只是在第61条第2款作了原则性的禁止规定,缺乏可操作性。鉴于现有立法之不足,通过对各国关于自我交易规定的比较研究,试图确立符合法理的实体和程序规则,使得我国公司法上的自我交易问题得到有效解决。     

Can we remember differently? A case study of the new culture of memory in voluntary organisations

This article analyses the positive contribution that Slovenian voluntary, non–governmental organisations, users' organisations and community–based services in the field of mental health have made to the 'new culture of memory' of helpers and users. The conceptual differences between Slovenian psychiatric (institutional) treatment and voluntary community care are presented through the case study of Clare, a young woman who was diagnosed as a chronic schizophrenic. This example shows the importance of community care in voluntary organisations for the reduction of disability associated with mental disorders. The development of the new culture of memory in voluntary organisations and community–based services is not only the 'narrative turn' within social welfare, but also symbolises the 'implicit turn' in the relationship between the helper and the user. The real challenge of the new culture of memory in the process of help to disabled people (in respect of individuals working through traumatic memories) is that the helper can bear and support the user on a daily basis. During the process of their relationship, the deep implicit relational memories of both become activated and influence the change within the user as well as the helper.     

论改进我国企业环境信息报告

我国企业环境信息报告存在的问题是报告目标单一,内容不完整,模式不规范。在可持续发展战略条件下,企业既要向政府主管部门提供环境信息报告,也应向投资者、债权人、社会公众等提供企业环境影响信息。因此,有必要改进企业环境信息报告。主要措施包括:培养和提高信息使用者的环境意识,开展可持续发展教育;健全法制环境,加大环境监管力度;发挥会计职业界的作用,鼓励会计师事务所开展环境信息审计业务。

Model Diagnostics for Remote Access Regression Servers

To protect public-use microdata, one approach is not to allow users access to the microdata. Instead, users submit analyses to a remote computer that reports back basic output from the fitted model, such as coefficients and standard errors. To be most useful, this remote server also should provide some way for users to check the fit of their models, without disclosing actual data values. This paper discusses regression diagnostics for remote servers. The proposal is to release synthetic diagnostics—i.e. simulated values of residuals and dependent and independent variables–constructed to mimic the relationships among the real-data residuals and independent variables. Using simulations, it is shown that the proposed synthetic diagnostics can reveal model inadequacies without substantial increase in the risk of disclosures. This approach also can be used to develop remote server diagnostics for generalized linear models.     

Beyond recruitment: Predictors of differential participation in a national antihunger organization

Surprisingly little research has sought to explain differential participation after recruitment into social movement organizations (SMOs). This study examines the influence of several sets of predictors on participation by members of a national organization in the antihunger movement. The findings highlight the importance of incentive, ideological, and microstructural factors for differential participation and suggest that favorable perceptions of SMOs also promote participation. Final remarks address the implications of the findings for the social movement and voluntary organization literatures.     

中国上市公司高管人员报酬信息披露研究

中国上市公司高管人员报酬信息披露仍然存在很多不足之处。本文从公司治理的角度,通过借鉴美国上市公司高管报酬信息披露制度,结合中国特殊制度背景,提出完善中国高管人员报酬信息披露的政策建议,以期促使上市公司建立与股东利益相一致的高管人员薪酬契约。
