Jurisdiction-stripping has long been a questionable component of Congress's power to supervise the judiciary's policymaking role. It has gained notoriety in recent debates surrounding judicial involvement in areas including religious establishment and privacy issues such as abortion and same-sex marriage. Most scholarship equates the advocacy of jurisdiction-stripping measures with symbolic position-taking that is unmotivated by the goal of traditional policy success. This work, a quantitative case study of the first such measure to pass the House of Representative since Reconstruction, seeks to isolate legislative motivations for exerting jurisdictional controls against the Supreme Court. Legislators’ votes on this measure were multifaceted. While those decisions were guided in part by the symbolic and representational considerations that traditionally underlie the advocacy of such legislation, there is also evidence more substantive motivations played a part. The study highlights the evolving objectives of jurisdiction-stripping's advocates and, more broadly, Congress's objectives vis-à-vis the courts. 相似文献

In recent years there has been a marked increase in the study of the influence of leadership on creativity, and the effects of this relationship on organizational performance. While a number of explanations have been broached with regard to the positive effects of leadership on creativity, many of these studies propose different, and often contradictory, methods for leaders to achieve these positive effects on creativity within their organizations and work groups. Additionally, little work has been done examining the effects of leadership on highly creative people in fields requiring creativity. The purpose of this study is to examine two existing leadership theories with regard to their viability as models to explain creative performance of eminent scientists. Eminent scientists represent a population of leaders of highly creative individuals in a field that values the production of innovative ideas and products as a marker of performance. Ninety-three excerpts from the biographies of scientists were content coded for leader behaviors and performance criteria. The results of this analysis indicate that a model based on strategic planning and product championing may serve to explain the positive effects of leadership on creativity in a highly creative population. 相似文献

A new version of the age-old controversy between religion and science has been launched by today’s intelligent design movement.
Although ostensibly concerned simply with combating Darwinism, this new creationism seeks to drive a “wedge” into the materialist
view of the world, originating with the ancient Greek philosopher Epicurus and manifested in modern times by Darwin, Marx,
and Freud. Intelligent design proponents thus can be seen as challenging not only natural and physical science but social
science as well. In this article, we attempt to explain the long history of this controversy, stretching over millennia, and
to defend science (especially social science) against the criticisms of intelligent design proponents – by defending science’s
materialist roots.

Relocation stress syndrome is a nursing diagnosis characterized by symptoms such as anxiety, confusion, hopelessness, and loneliness. It usually occurs in older adults shortly after moving from a private residence to a nursing home or assisted-living facility. The primary purpose of this study was to validate the symptoms of relocation stress syndrome. Eight nursing home residents and 8 assisted-living facility residents were interviewed 2 to 10 weeks after admission, when symptoms of relocation stress syndrome are most likely to appear. Results of this study indicate that the incidence of relocation stress syndrome may be overestimated. More accurate diagnosis and treatment of depression in older adults is needed. 相似文献

The use of lower probabilities is considered for inferences in basic jury scenarios to study aspects of the size of juries and their composition if society consists of subpopulations. The use of lower probability seems natural in law, as it leads to robust inference in the sense of providing a defendant with the benefit of the doubt. The method presented in this paper focusses on how representative a jury is for the whole population, using a novel concept of a second ’imaginary’ jury together with exchangeability assumptions. It has the advantage that there is an explicit absence of any assumption with regard to guilt of a defendant. Although the concept of a jury in law is central in the presentation, the novel approach and the conclusions of this paper hold for representative decision making processes in many fields, and it also provides a new perspective to stratified sampling. 相似文献

The Texas Commission on Environmental Quality (TCEQ) has developed an inhalation unit risk factor (URF) for 1,3-butadiene based on leukemia mortality in an updated epidemiological study on styrene-butadiene rubber production workers conducted by researchers at the University of Alabama at Birmingham. Exposure estimates were updated and an exposure estimate validation study as well as dose-response modeling were conducted by these researchers. This information was not available to the U.S. Environmental Protection Agency when it prepared its health assessment of 1,3-butadiene in 2002. An extensive analysis conducted by TCEQ discusses dose-response modeling, estimating risk for the general population from occupational workers, estimating risk for potentially sensitive subpopulations, effect of occupational exposure estimation error, and use of mortality rates to predict incidence. The URF is 5.0 × 10−7 per μg/m3 or 1.1 × 10−6 per ppb and is based on a Cox regression dose-response model using restricted continuous data with age as a covariate, and a linear low-dose extrapolation default approach using the 95% lower confidence limit as the point of departure. Age-dependent adjustment factors were applied to account for possible increased susceptibility for early life exposure. The air concentration at 1 in 100,000 excess leukemia mortality, the no-significant-risk level, is 20 μg/m3 (9.1 ppb), which is slightly lower than the TCEQ chronic reference value of 33 μg/m3 (15 ppb) protective of ovarian atrophy. These values will be used to evaluate ambient air monitoring data so the general public is protected against adverse health effects from chronic exposure to 1,3-butadiene. 相似文献

Having a child with a disability is considered a barrier to self-sufficiency among welfare recipients. This study examines the impact of children's educational disability on single-mother families' welfare exits and re-entries for a cohort of children in a metropolitan region in Missouri, who were born between 1982 and 1994, and received AFDC/TANF at least once from 1990 through 2008 (N=4,928). A semiparametric proportional hazards model for recurrent events is used to analyze the relationship between a child's educational disability and family welfare exit and re-entry. Results show that families with children with disabilities (the disability group) are less likely to exit and more likely to re-enter the welfare system than families with children without disabilities (the nondisability group). After the 1996 welfare reform, the welfare exit rate increases more for the disability group than for the nondisability group, while the welfare re-entry rate decreases less for the disability group than for the nondisability group. 相似文献

Contamination of a sampled distribution, for example by a heavy-tailed distribution, can degrade the performance of a statistical estimator. We suggest a general approach to alleviating this problem, using a version of the weighted bootstrap. The idea is to 'tilt' away from the contaminated distribution by a given (but arbitrary) amount, in a direction that minimizes a measure of the new distribution's dispersion. This theoretical proposal has a simple empirical version, which results in each data value being assigned a weight according to an assessment of its influence on dispersion. Importantly, distance can be measured directly in terms of the likely level of contamination, without reference to an empirical measure of scale. This makes the procedure particularly attractive for use in multivariate problems. It has several forms, depending on the definitions taken for dispersion and for distance between distributions. Examples of dispersion measures include variance and generalizations based on high order moments. Practicable measures of the distance between distributions may be based on power divergence, which includes Hellinger and Kullback–Leibler distances. The resulting location estimator has a smooth, redescending influence curve and appears to avoid computational difficulties that are typically associated with redescending estimators. Its breakdown point can be located at any desired value ε∈ (0, ½) simply by 'trimming' to a known distance (depending only on ε and the choice of distance measure) from the empirical distribution.
