论“行政契约”的判断标准

摘    要:从大陆法系几个主要国家(地区)对行政契约含义的阐释来看,行政契约的判断标准主要有:一、以德国和我国台湾地区为代表的"契约标的理论",即行政契约是以发生、变更或消灭行政法上的法律关系为标的;二、以法国和日本为代表的"三标准":即以"合同主体"+"公务目的"+"特殊权力保留条款"作为行政契约的判断标准;三、混合标准:我国内地部分学者采契约标的理论,部分采三标准,部分将契约标的理论和三标准共同作为行政契约的判断标准。

Abstract:Based on the interpretation of administrative contract in the countries from the continental law system,the judgment standard of the administrative contract mainly includes: One,the "contract theory" with Germany and Taiwan as a representative;Two,the "three standards" with France and Japan as a representative;Three,the mixed standard: some scholars in mainland China adopt the theory of contract mark,some three standards,and some use contract mark theory and three standard as the judgment standard of the administrative contracts.
