论抵押权与其他担保物权竞合的效力

摘    要:在担保物权制度中,以担保方式的不同可分为抵押权、留置权、优先权、质权等。以上各类担保物权都具有优先受偿的效力,这是由其物权性质所决定的。但是,在同一债务人的财产上存在数个不同的担保物权时,谁应优先受偿呢?这不仅是实践上一个十分复杂的问题,而且在理论上也是颇多争议。本文拟以抵押权与留置权、优先权、质权在同一财产上的竞合效力问题进行探讨。

Abstract:Real rights of security can be divided into mortgage, pledge, lien, priority, etc. Rights mentioned above have the effect to be compensated first because of their essence of real rights. However, a problem occurs that who should compensate first, when these real rights exist on a debt at the same time. This problem is complicated and controversial in practice as well as in theory. My essay mainly centers on the relationship between mortgage and lien, priority, pledge, when they are concurrent on the same debt.
