| 摘 要： | 惩罚性赔偿是英美法系一项重要的制度。英、美两国在国家公权力侵权行为中都有适用惩罚性赔偿的判例。从实际运作来看,两者在适用情形、适用目的、适用限制等方面存在着些许共同点。以此为借鉴,我国可以确立二元的国家赔偿标准,即在一般情况下,适用补偿性赔偿标准 在出现＂故意和重大过失＂情形下,追加适用惩罚性赔偿。对惩罚性赔偿金,要在必要限制的基础上进行科学算定。

| Abstract: | The punitive damage compensation is an important institution in civil-law-system countries.In the USA and the UK,there are many cases of the state punitive damage compensation.They have some common points on the conditions,purposes and restrictions of the compensation.On the reference of those norms,we could establish binary state damage compensation standard,which means that in the common instance,we could adopt the compensatory damage compensation,and in the instance of ＂intent and gross negligence＂,we could adopt the punitive damage compensation additionally.Furthermore we should calculate the state punitive damage compensation on the basis of necessary restriction. |
