| 摘 要： | 现代成年人监护制度以尊重身心障碍者“自我决定权”及“维持生活正常化”理念为指导,根据其本人生活需要相应设立保护措施,以因应社会日益高龄化的客观情势,蕴涵着平等、自由、公平及秩序等价值理念.我国成年人监护法应以现代成年人监护法蕴涵的价值理念为目标,从我国实际出发,并借鉴国外立法经验,适时予以修正,以体现以人为本、私法自治的精神,满足维护身心障碍者利益的现实需要.

| Abstract: | The modern adult guardianship system aims to respect self-determination and maintain the normal hves ot mentally-ill people. It shall establish protective measures to meet the needs of the elderly based on their situations. The modern adult guardianship system contains the legal value of equality, freedom, fairness and order. The Chinese system of modern adult guardianship shall drawing lessons from foreign legislation an reflect the spirit of people and autonomy of aim to realize the legal value of the modern adult guardianship system by d the reality of China to improve relevant laws and regulations so that they private law in meeting the practical needs of the disabled. |
