婚姻关系适用合理信赖保护之思考

婚姻是男女双方以共同生活为目的的两性结合，是建立在婚姻当事人彼此间的积极的信赖之上的。婚姻当事人因缔结婚姻而产生信赖关系，应当自觉提供给付，履行承诺义务，并为维持亲密的共同生活，在情感上和物质上进行信赖投资行为。结婚是取得婚姻财产权的方式，婚姻当事人因缔结婚姻而享有婚姻财产权的共有性。并以共有人身份共同处理为婚姻生活所必需的财产。这是婚姻关系适用合理信赖的积极保护方式。若由于一方可归责性的原因而不当解除婚姻关系时。亦有必要适用合理信赖保护原则，以信赖利益损害赔偿的方式对不当退出的一方进行离婚经济赔偿，这是婚姻关系适用合理信赖的消极保护方式。
