| 摘 要： | 分析了侵权法主要解决的问题是能否在受害方与施害方之间达成一个可执行的契约 ,使侵权的私人成本与社会成本趋于一致。认为一个有效合理的侵权损害赔偿法律制度应围绕激励而不是强制 ,只有激励行为主体投入一定预防成本才能避免损失的发生。并建立了一种分析与解决问题的模型。

| Abstract: | The authors analyze the main problem that tortious law settles, if compassing a performable contract between the victim and the victimizer, can make the private cost and social cost of tortious go consistently. An available and reasonable system about tortuous damage compensation ought to stimulate not compel. Only stimulating act body launched victim into a certain preventing cost can avoid the losing occur rence.A model to analyze and solve this problem is set up. |
