| 摘 要： | 合同履行障碍论为理解合同法各个制度之间的联系提供了新的视角，为解决债法各部分之间的边缘性问题提供了新的思路。以实现债权人的给付利益为目标，现代合同法律关系表现出明显的有机性和程序性特征。合同义务从缔约接触开始，经过给付阶段，迈向合同终止后的给付利益维持阶段。与这一过程相适应，合同履行障碍法在时间上的扩张成为必然。

| Abstract: | The theory of contractual performance obstacles provides not only a new perspective for understanding the link between the various systems of contract law but also a new way to solve the delicate controversies between the different parts of debts law. In order to realize the creditors＇ performance benefits, modem contract legal relationship embodies obvious procedural and organic characteristics. Contractual obligations commence from contracting negotiation, passing through performance phrase towards fulfillment benefits maintenance phrase after the termination of a contract. Accordingly, the contractual performance obstacle system will inevitably expand temporally. |
