同性恋性犯罪问题探讨

同性恋作为一类特殊人群的生活方式,近年来越来越受到社会的关注,涉及同性恋性犯罪问题也屡见报端。对于组织同性卖淫行为和奸淫同性行为,是否应当予以刑罚处罚,法律规定不明确甚至缺失,导致司法实践部门意见不一或者对行为人处罚不力,使被害人的权利得不到应有的保护,社会的正常秩序受到破坏。为此,笔者提出,应以修正案的方式完善我国相关立法。

An Exploration of Sex Crimes of Homosexuality

Homosexuality as a life style of a special group of people has received more and more attention from the society and the sex crimes of homosexuality frequently appear in newspapers.We have not clear or lack of regulations concerning whether it should be punished or not to organize homosexual prostitute and conduct homosexual adultery so as to cause not forceful punishment by the legal departments and not to protect the rights of victims and to damage the social regular order.Therefore,the author points out that it should perfect our relevant legislations.
