民族自决框架下全民公决的条件限定

民族自决原则和国家领土完整原则是国际法确认的强制性规范。在殖民独立时期，两项原则和谐共存，但后冷战时期，两项原则矛盾突显。这源于对民族自决原则的界定不清，以及民族分离主义的干扰。分离权只有很少一部分能用民族自决来规范，现今国家国内民族的“独立”实际上都是分离。行使这种分离权需要依靠全民公决，公决本身也有严格的条件限定。我国少数民族或者边界地区绝无可能脱离我国的主权领土，因为我国并不存在关乎人权的不合理措施对待。

Restrict of Conditions on Referendum in the Frame of Self-Determination

Principle of self‐determination of peoples and principle of territorial integrity of states are mandatory rules confirmed by international law .These two principles coexisted in harmony during Colonial Independence Era ,but during Post‐Cold War Era the contradiction between them was growing sharper .It went because there was no clear definition of principle of self‐determination of peoples and national secessionism intervened .Only a small part of right of separation can be bind by self‐determination and nowadays national independence of nations is actually separation .Exercising this right relies on referendum restricted by hard conditions .China’ s national minority or boundary areas are absolutely impossible to separate from our sovereign territory because there is no treatment of unreasonable measures related to human rights in our country .
