| 摘 要： | :本文着重分析了金融资产管理公司运行中存在的法律障碍及法律空白,表现在对AMC准确定性与定位的欠缺;AMC收购不良资产,处置不良资产等行为与现行合同法、担保法、公司法、证券法存在冲突;外资参与处置不良资产法律阙如;AMC法律位阶低等等,探讨了制定有关AMC特别法的可行性及从三个方面进一步完善AMC法律制度的设想。
