试论法人的非财产损害赔偿

我国最高人民法院出台的《关于民事侵权精神损害赔偿若干问题的解释》中第5条明确否定了法人的非财产损害赔偿请求权,但现有的财产损害赔偿不能补偿法人的精神损伤。现行法确认了法人犯罪和法人侵权责任,因而也应当承认法人的非财产损害赔偿请求权。非财产损害赔偿的发展趋势倾向于赋予法人非财产损害赔偿请求权。法人的非财产损害赔偿可以分为侵害法人一般人格权的非财产损害赔偿以及侵害法人商号权、商誉权、信用权和商业秘密权等具体人格权的非财产损害赔偿。

In the 5th article, it has denied the right of non - pecuniary loss compensation of legal person. But now the property damage compensation can not equalize the mental damage of legal person. According to the provisions of law, the legal person can commit a crime and make intrusions, so we should admit the right of non - pecuniary loss compensation for legal person. The development trend of compensation for non - pecuniary loss tends to endow the legal person with the right of non - pecuniary loss compensation. We can classify the non - pecuniary loss compensation for legal person as the compensation for general personality right of legal person and the compensation for particular personality right of legal person such as the right of trade name, the reputation right of a firm, the right of credit and the secret right of a firm.
