法治现代化中习惯法地位之刍议

习惯法作为规制社会秩序的有效本土资源，在构建和谐社会蓝图时，是不能小视的重要资源。在今天实现法治现代化的路径选择上，习惯法的地位更显重要，是通过移植西方法律成就中国的法治现代化，还是利用本土资源实现中国的法治现代化。在此较量中，习惯法当仁不让的扮演着与国家法共同承担维护国家发展和社会秩序大任的角色，这也是利用本土资源实现中国法治现代化的必由之路。因此，搞清楚习惯法的含义、厘清习惯法与国家法之问的关系就显得尤为重要。

As an efficient native resource which rule social order,the customary law could not be neglect when building a harmony society.The customary law play especially important role to realize law modernization, through which choosing the way to transplant western law or using native resource.Undoubtedly,in this argue, the customary law act a crucial part as well as state law that stick up for national development and social order, and it is also the only way to realize law modernization in China.So,it is necessary for us to beat out the concept of customary law and the relationship between the customary law and the state law.
