| 摘 要： | 资产证券化是一种新型的金融创新工具,在西方发达国家已取得显著的成就,其市场已具有相当的规模。资产证券化引发了一系列法律问题,其有效运作和风险控制离不开法律制度的支持和保障。在我国,资产证券化刚刚起步,有关部门正着手研究利用资产证券化处置商业银行的不良资产,但现阶段开展资产证券化存在若干法律障碍,必须加深相关法律制度的研究。

| Abstract: | The securitisation of the assets is a kind of new-type innovative tool of finance,which has already made the remarkable achievement in the western developed countries,and its market has had a large scale.The securitisation of the assets has caused a series of legal questions,and its effective operation and risk controlling can not leave the supports of the legal system.In our country,the securitisation of the assets just started,and the related departments are setting about studying the non-performing assets using the securitisation of the assets to handle the commercial bank,but launching the securitisation of the assets has several legal obstacles in the present stage,so we must strengthen the relevant legal research of system. |
