| 摘 要： | 分析过错侵权责任的构成要关键是廓清"过错"与"违法性"的内涵,从二者的渊源及各国司法实践来看,二者指称的是同一事物,即违反了客观注意义务,"过错"作为过错侵权责任的构成要件更为恰当.医疗过错主要是过失,意指医师违反其注意义务的行为.医疗损害侵权责任的构成要件是医疗损害、医疗过失和因果关系.

| Abstract: | The key to analysing the constitutive requirements of faulty tortuous liability is to differentiate fault and injuria in connotation. Judged from their origins and the countries′ judicial practices,both fault and injuria refer to the same action,namely,failing to fulfill one′s duty of care objectively. It is more suitable for fault to be one of the constitutive requirements of faulty tortuous liability. Medical fault mainly results from medical negligence,which is the action that doctors violate the duty of care. The constitutive requirements of tortuous liability for medical injuries are medical injuries,medical negligence and causation. |
