真正身份犯与实行犯关系的认定——兼论共同犯罪既遂的标准

真正身份犯的主要特征是只有具备该特定身份的人才能单独实施全部犯罪的实行行为;在真正法律身份犯的情况下,同样存在间接正犯的可能;有身份者教唆、利用无身份而有刑事责任能力的人实施真正身份犯,有身份者和无身份者均构成直接正犯;在共同身份犯的情况下,不可能存在部分犯罪人犯罪未遂或中止,而其他共犯既遂的情况.

The character of standard status crime is only those with the status can fulfill all of the act of perpetrating;the legal status crime can become indirect guilt.If people with the crime status instigating or exploiting those who do not have the crime status but have the capacity to perpetrate a status crime,both are direct guilt.In the simple joint offense,once one of the joint offenders accomplishes a crime,the others cannot be discontinuance of crime or inchoate crime.
