走出环境公害治理模式的误区——来自美国环境公害治理模式的启示

环境公害泛滥是我国当前突出的社会问题,而我国现行环境公害治理模式与一些学者的主张却走进了误区.美国环境公害治理的经验表明,以“命令-控制”为主的单轨模式难以有效遏制环境公害事件,必须采用“命令——控制”与“私人总检察官”相结合的双轨模式.受美国环境公害治理模式的启示,我国应引入“私力执行”模式,以制约和补充“公力执行”之不足,赋予公民在环境公益诉讼中的原告资格,并消除公民提起环境公益诉讼的障碍.

The US experience in controlling environmental hazards has shown that it is difficult to curb the problem of environmental hazards effectively with the mode of ＂command - control＂, and the two - track mode that combines ＂command -control＂ with ＂Private Attorney General＂. By the revelation of the con- trol model of environmental hazards in America, China could introduce a ＂private force＂ model to implement and constrain ＂public force＂. At the same time, the citizens should be given the plaintiff qualification in the environmental public interest litigation so as to eliminate the obstacles of environmental public interest litigation.
