Studies on Intellectual Property Right Permission and Monopoly Behavior

While the world is strengthening the protection of intellectual property right, they are also paying attention to the abuse of intellectual property right. Permission is one of the possible way that may bring in intellectual property right abuse. This article discussed the legal practices of anti-monopoly in the U.S., the E.U. and Japan, took some typical clause in the intellectual property right permission contract for case study, and analyzed the complex relations between intellectual property right protection and monopoly behavior. This helps to conclude the experience of legislation of anti- monopoly and discipline behavior of intellectual property right abuse.
