我国企业环境侵权社会化救济的思考

环境问题在现代社会越来越严重,而企业作为市场主体,是环境资源的主要利用者和环境污染的制造者,也是我国环境侵权的主体。因此,研究环境侵权的社会救济,加强企业承担环境责任,对减少环境污染,保护生态环境,维护公民的合法权益,实现经济可持续发展具有重要意义。而现阶段中,在环境侵权的救济手段中存在诸多问题,立法的不健全,政府监督不力,企业自身对环境责任认识的不足,社会舆论和公众方面参与的不足都给环境侵权的救济带来障碍。鉴于此,需要对以上问题进行完善分析,提出加强企业履行环境责任,引入环境侵权社会化救济的必要性,同时从立法、政府、企业、社会等方面来探析我国企业环境侵权的救济手段。

Consideration of the Socialization Relief System of Environmental Tort of China's Enterprises

Environmental issues are becoming more and more serious in modern society.The market entities of enterprises which the primaries use of environmental resources and the bad environment polluters,and also the subject of environmental tort.Therefore,the study of environmental tort’s social relief could enhance the corporate environmental responsibility,reduce the environmental pollution,protect the environment,safeguard the legitimate rights and interests of citizens and achieve sustainable economic development.At this stage,there are many problems in the environmental tort remedies,for example,the legislation is not perfect,poor government oversight,the enterprises lack of awareness of environmental responsibility,the insufficient of public opinion and public participation.All these have caused environmental infringements obstacles.In view of this,these questions need refined analysis,strengthening the enterprises to fulfill their environmental responsibilities and introduced the necessity of environment tort’s social relief.While from legislation,government,business and social aspects our corporate environmental tort remedies.
