经济法的社会正义观

作为社会经济和法学共同发展的产物,经济法所调整的社会关系具有其特殊性,这决定了它所追求的价值理念以及建立于其上的正义观就不同于其他的部门法。经济法追求社会正义的实现。社会正义以社会利益的整体提高为根本出发点,这主要是通过平等原则与差别原则在经济法得以遵守来实现的。平等原则是在经济法领域内实现社会正义的主要原则,而起矫正作用的差别原则是辅助性原则。形式正义和实质正义是完善的法律制度不可分割的两个方面,每一法律部门都同时追求形式正义和实质正义的实现,实质正义不是经济法所独有的正义观。

Social justice conception in economic law

As a product of development of social economy and law, economic law has its particular social relationship to adjust. Economic law has different values and justice outlook based on the relationship it adjusts than those of other branches of law. Economic law pursues the realization of social justice. The starting point of social justice is to improve social interest in all aspects and the goal is achieved by two principles: equality principle and difference principle. Equality principle is the main one to realize social justice in economic law and difference principle that plays an corrective role is an auxiliary principle. Formal justice and substantial justice are the two sides of a coin in every branch of law. Every branch of law pursues the realization of formal justice,and the substantial justice and substantial justice is not the only valued pursued by economic law.
