| 摘 要： | 限制权利为确保权利实现所必需,克减是一种权利限制.克减应该有明确的目的性和必要性,一些基本权利在任何情况下都不能克减;克减的价值功能是权利限制的价值功能的体现,而不可克减的权利不仅在形式上是克减功能发挥的纠偏机制,在价值功能上则是克减价值功能的具体体现和升华.
