| 摘 要： | 行政权推定行使,已成为行政权越权、滥用的基本口实。本文从权力不得推定出发,阐明了行政权不得推定的理由依据,指出其现象表现。并在此基础上,提出行政权法定,为行政权的行使设定了基本界域。
