| 摘 要： | 惩罚性赔偿是普通法上一项独特的制度,在适用中衍生出若干法律问题。针对惩罚性赔偿金数额的不确定性、惩罚性赔偿金的归属以及惩罚性赔偿的可保性问题,探讨美国法上的各种解决方案,以资为我国相关制度的完善提供借鉴。
