| 摘 要： | 传统观点认为不能犯是犯罪未遂的一种,所有的不能犯均构成犯罪。这种观点没有正确理解刑法意义上的危害行为,事实上不能犯分为可罚的未遂犯与不可罚的不能犯。结合外国刑法学关于不能犯的理论,论述了可罚的未遂犯与不可罚的不能犯的区别及判断方法。

| Abstract: | It is generally believed that impossibility of crime is a type of unaccomplished crime. In effect, impossibility can be divided into two categories: punishable impossibility and non-criminal impossibility. The paper also probes into the foreign impossibility theory and puts forward some advice on how to differentiate the two kinds of impossibility. |
