金融危机与金融安全的国际法思考

金融是现代经济的核心,金融全球化是国际金融发展的大趋势。金融全球化有其利也有其弊,近年来多次金融危机逐渐变为2008年全球金融危机,是与之关联的。当前全球金融危机意味着一个＂时代的终结＂,给世界带来一些重要的警示：一是金融创新要适度,金融监管要完善;二是＂虚拟经济＂不能远离实体经济;三是居民的消费需求不能严重超过居民的收入;四是构建公平有效的全球金融监管体系,构建没有货币霸权的全球货币体系。防范全球金融危机需国际间的法律防范与合作措施。对国际金融法应有一些新的思考：一是在总纲中要明确建立起一个全球公平、公正、有效的国际金融新秩序。二是国际金融法必须包括金融交易、金融规则和监管关系。三是改进国际货币制度。四是际银行监管合作制度。五是国际证券监管制度。六是国际保险监管制度。

Reflection on International Law of Financial Crisis and Security

Economic globalization,in which finance is the core element,is the general trend in modern world. It has advantages as well as disadvantages which was testified by global financial crisis in 2008 resulted from several crises in recent years. At present,worldwild financial crisis implies that there comes the terminal of an era,which brings certain crucial warnings. Firstly,reasonable financial innovation and perfect financial supervision are essential. Secondly,virtual economy shouldn＇t be divorced from real economy. Thirdly,the consumption demand of inhabitants shouldn＇t surpass their income severely. Finally,it＇s necessary to establish fair and effective supervisory system and international monetary system without financial hegemony. Therefore,international legal precaution and cooperation are needed so as to prevent from global financial crisis. Concering International Financial Law,there are six aspects should be considered：1.To establish fair,reasonable and effective financial system; 2. International Financial Law should consis of financing trade,financing rule and financing supervision; 3. To reform International Financial Law; 4. To improve bank supervision and promote cooperation; 5. To refine international securities supervision; 6. To perfect international insurance supervision.
