82宪法与中国的法治建设

8 2宪法被公认为是我国宪法史上最好的一部宪法 ,对我国的法治建设起着十分重要的规范和保障作用。82宪法确认国际公认的法治原则 ,较好地体现了宪法的法治功能和价值 ,特别是 99修宪明确规定国家实行依法治国 ,建设社会主义法治国家 ,标志着我国社会主义法治建设进入了一个新的历史阶段。但是 ,82宪法在运行中也暴露出一些缺憾 ,这与其对中国法治建设推进方式的选择和具体的制度设计有一定的关联。中国法治建设的实践必然会促进 82宪法的进一步完善 ,而 82宪法的不断完善又会对中国法治建设起着更好的规范和保障作用

The 1982 Constitution and Chinese Construction of Rule of Law

The 1982 constitution is acknowledged to be the best one in Chinese constitution history,and has played an important role in regulating and safeguarding Chinese construction of rule of law.It affirms the internationally accepted principles and values of law,thus giving better expression to the functions and values of rule of law. Particularly,the 1999 amendment added stipulations that call for ruling state by law and building up a socialist state of rule of law,which marks our socialist construction of rule of law is getting into a new historical period.However some imperfections are exposed during implementation of 1982 constitution,which is due to the specific system design as well as the choice of ways by which the constitution pushes forward constrution of rule of law will definitely promote further perfection of 1982 constitution,whose continuous development will make Chinese constrution of rule of law further regulated and safeguarded.
