| 摘 要： | 《最高人民法院关于审理涉外民事或商事合同纠纷案件法律适用若干问题的规定》非常注重对我国国际私法相关理论研究成果的吸收，填补了我国立法在相关领域的空白。但在“民事、商事合同”明确界定、“弱势方合同”法律适用的特殊性、涉及我国台湾地区合同争议的法律适用问题等方面尚有不足，需加以完善。

| Abstract: | The Regulations of the Supreme People＇s Court on Issues Concerning the Application of Law in Adjudication Cases of Disputes over Foreign-related Civil or Commercial Contracts is the latest judicial interpretation on application of law of foreign-related contracts in China, it absorbs the study results of Chinese private international law and fill legislation blank in the relevant fields in China. However, in the clearly defined ＂civil and commercial contract＂, the specificity of the application of the law ＂ contract for the disadvantaged＂ and the application of the law on the issues of contractual disputes involving Taiwan, there are some shortages and need to be improved. |
